In a pocket rescission, the timing is critical: the request is made so late that the 45-day period extends beyond the funds’ expiration date, causing them to lapse before they can be spent, even if Congress disapproves or takes no action. This effectively allows the executive branch to cancel funds without Congressional approval, bypassing Congress’s constitutional “power of the purse.”
