The "de minimis loophole" refers to a U.S. trade provision, the de minimis exemption, that allowed low-cost shipments valued at $800 or less to enter the country duty-free, which was officially ended on August 29, 2025, by an executive order from President Trump. This change means that many e-commerce imports will now be subject to tariffs, potentially leading to higher prices for consumers and significant shifts for online retailers, especially those like Shein and Temu that relied heavily on this provision.
What it was:
Duty-Free Imports:
The de minimis exemption allowed for the duty-free import of shipments valued at $800 or less, simplifying customs procedures for small packages.
Spur to E-commerce:
This rule facilitated the growth of online marketplaces and e-commerce by reducing costs and shipping delays for small businesses.
Why it was called a "loophole":
Abuse by Large Companies:
Critics argued that large retailers and e-commerce platforms, particularly from China, abused the de minimis exemption to avoid tariffs on high volumes of goods that should have gone through the standard, more regulated, import process.
Increased Shipments:
The exemption led to a surge in low-value shipments, with the U.S. Customs and Border Protection (CBP) handling millions of packages daily.
Concerns about Illicit Goods:
The huge increase in volume and reduced oversight also raised concerns about the increased potential for counterfeits, narcotics, and other illicit goods to enter the country.
What happened (The End of the Exemption):
President Trump's Executive Order:
On August 29, 2025, President Trump issued an executive order ending the de minimis exemption for all countries.
Tariffs on Low-Value Imports:
Now, these low-cost shipments will be subject to standard tariffs and customs processing based on their value and country of origin.
Impact of the Change:
Higher Prices for Consumers:
Many online retailers are expected to pass the new tariff costs onto consumers, leading to higher prices for imported goods.
Shifts in Online Retail:
The change is expected to negatively impact online retailers like Shein and Temu and may shift consumer purchasing toward domestic retailers or major platforms.
More Oversight:
The closure of the de minimis rule allows for greater scrutiny of incoming low-cost goods, which is expected to reduce the flow of counterfeit and dangerous products.

Foreign sellers have been allowed to flood the us market with goods so cheaply that american sellers couldnt compete. I know because i researched starting several different product lines that couldnt compete with zero tariff low postal fees foreign products. This is a good thing for american small business. Now we can compete in our own market
