Angela Rayner, the UK's Deputy Prime Minister and Housing Secretary, has admitted to underpaying stamp duty on the purchase of her £800,000 seafront flat in Hove, East Sussex, due to reliance on flawed legal advice concerning a trust established for her disabled son.
She has referred herself to the Independent Adviser on Ministerial Standards and is working with HMRC to resolve the matter, acknowledging she did not pay the required £70,000 in stamp duty, instead paying only £30,000.
The funds used for the deposit came from the sale of a 25% share of her former home in Ashton-under-Lyne to the trust, which was created following a 2020 compensation award linked to her son’s premature birth and lifelong disabilities.
Stamp Duty Underpayment: Rayner admitted the error after seeking advice from a leading tax barrister, confirming that complex "deeming provisions" related to her son's trust triggered an additional stamp duty liability, despite her not owning another property at the time of purchase.
She stated she relied on initial legal advice that indicated the standard rate applied, but now accepts the advice was flawed.
Source of Funds: The £162,500 from the sale of her stake in the Ashton-under-Lyne property to the trust was used as part of the deposit for the Hove flat, with the remainder financed by a £650,000 mortgage.
The trust was established following an 11-year legal battle with the NHS over her son’s care at birth in 2008, resulting in a compensation award.
Current Status: Rayner has confirmed she is working with expert lawyers and HMRC to settle the outstanding tax liability, which could amount to an additional £40,000.
A court order previously restricting her from disclosing details of her financial arrangements has been lifted to allow for greater transparency.
