NJ doctor resigns after nurse said he 'cheered' Charlie Kirk's death – nurse reinstated (but suspended)

 

A New Jersey doctor accused of celebrating conservative activist Charlie Kirk's assassination has resigned, and the nurse who reported him will get to keep her job, the hospital where they worked told Fox News Digital.

 

Englewood Health says it "diligently investigated" the September 10 incident "between a doctor and a nurse in a patient care area." The update came after nurse Lexi Kuenzle, 33, sued Englewood Health and Dr. Matthew Jung, alleging that Jung "cheered and celebrated" Charlie Kirk's assassination in comments made in front of patients and hospital staff, and that she was suspended after she reported him.

 

While the findings of the hospital's investigation have not been disclosed, a spokesperson for the healthcare provider told Fox News Digital in an email that it has "[a]ccepted the physician’s resignation, and the nurse is expected to work her scheduled shifts."

 

The spokesperson went on to say, "The nurse was never fired; was never told she would be fired by Englewood Hospital; and will not miss any pay as part of our review of this matter."

 

Kuenzle, who appeared on "Fox & Friends" Monday morning with her attorney John-Paul Deol of the Dhillon Law Group, told host Brian Kilmeade that she did not know who Dr. Jung was prior to their interaction on Wednesday.

 

"He was standing there, celebrating the death of Charlie Kirk, saying how ‘he deserved it,’ he hated Charlie Kirk and ‘he had it coming to him,’" the nurse, who considers herself "a big fan of Charlie Kirk" said.

 

"Speaking up wasn’t optional for me; it was my duty as a nurse to protect patients from that kind of cruelty and to uphold the integrity of our profession," Kuenzle said in a statement to Fox News Digital.

 

Her lawyer called Kuenzle's suspension "unjust" and "unlawful."

 

"We are pleased that Ms. Kuenzle has been offered the chance to continue in her position and receive the pay she was wrongly denied, and we will be working with the hospital to resolve the remaining details," Deol said in a statement to Fox News Digital.

 

Englewood Health's statement on Monday said that the hospital "is committed to providing a safe and respectful environment for all."

George Zinn arrested, charged with obstruction in Charlie Kirk case

-George Hodgson Zinn, 71, was arrested for investigation of obstruction of justice in the Charlie Kirk murder investigation.

-Police say Zinn claimed to shoot Kirk to divert attention from the actual shooter.

-Zinn was also arrested for investigation of sexual exploitation of a minor in a separate investigation.

 

OREM — Police say that a Salt Lake City man — who was no stranger to the state's political scene — claimed responsibility moments after the shooting death of conservative activist Charlie Kirk, in an attempt to "draw attention from the real shooter."

 

The arrest also sparked a child pornography investigation.

 

George Hodgson Zinn, 71, was booked into Utah County Jail for investigation of obstruction of justice and sexual exploitation of a minor on Monday, following a few days at a hospital. Newly released police documents also detail more of what happened that led to his arrest at Utah Valley University, which sparked a firestorm on social media.

 

After the lone shot was fired shortly after 12:20 p.m. last Wednesday, and as Kirk's security team rushed him to a hospital, officers at the scene reported that they saw an older man lying on the ground surrounded by people who appeared to be tending to him.

 

The man, later identified as Zinn, told the officer, "I shot him, now shoot me" twice, according to a jail report compiled by UVU police. The officer reported that he could not see a weapon, but he placed Zinn in handcuffs while others at the scene cleared the area.

 

Once in custody, Zinn continued to say he was the shooter, the report continued. Officers asked Zinn where the gun was, but they say he refused to tell them. He reportedly asked for his attorney when he was brought back to the university police headquarters for questioning, even after police said they didn't believe he was the shooter.

 

He later said he "did it to draw attention from the real shooter," police wrote in the report. He was first taken to a nearby hospital for an undisclosed medical condition. While at the hospital, Zinn told an officer that "he was glad he said he shot the individual so the real suspect could get away," the affidavit adds.

 

Zinn was released from the hospital on Monday and then booked into Utah County Jail.

 

Photos and video of his arrest quickly spread on social media, leading to erroneous reports that he was the shooter. Utah Department of Public Safety Commissioner Beau Mason announced that Zinn was taken into custody but had been cleared as the shooter within hours of his arrest.

 

Authorities ultimately determined that the single shot came from the roof of the nearby Losee Center, located about 175 to 200 yards from where Kirk was speaking underneath a tent. The single shot struck him in the neck, causing significant blood loss.

 

Kirk, 31, was later pronounced dead at the hospital. He was at UVU as part of the "American Comeback Tour" hosted by Turning Point USA, the organization that he founded.

 

Tyler Robinson, 22, of Washington, Washington County, was taken into custody late Thursday and booked into Utah County Jail on Friday for investigation of aggravated murder, felony discharge of a firearm causing injury and obstruction of justice. Authorities say charges in the case could be filed against Robinson as early as Tuesday. He's also scheduled to make his first court appearance.

 

Meanwhile, a motion was filed on Monday to hold Zinn without bail in relation to his arrest. It wasn't immediately clear if he had obtained any legal representation in the case. There is nothing in the police document to suggest that Zinn and Robinson were connected in any way.

 

Utah County sheriff's deputies also launched another investigation into Zinn while he was hospitalized.

 

FBI investigators interviewed him at the hospital, where he admitted he wasn't the shooter, but he also said he "uses (his) phone to look at child sexual abuse material" after initially refusing to let investigators go through his phone, according to a second jail report completed by the Utah County Sheriff's Office later on Monday.

 

Investigators went through the phone and found multiple images containing children believed to be approximately 5 years old, according to the affidavit. The FBI agents alerted deputies, who reviewed the phone and found more than 20 images of child pornography along with explicit messages about sexual acts.

 

Zinn has been arrested and charged numerous times over the past 30 years, mostly for trespassing in political spaces, according to state court records. He had been charged with criminal trespassing upon an institution, a class B misdemeanor, in Provo Justice Court earlier this month for an incident on Aug. 22.

 

Zinn also made headlines in 2013 after he was charged with making a threat of terrorism, a second-degree felony, in relation to an email asking if Salt Lake City Marathon organizers "needed anybody to help place bombs near the finish line," shortly after the Boston Marathon bombing. Court records show he later pleaded guilty to a lesser charge, amending it to a class A misdemeanor.

 

He was also one of five people arrested during a disruption at a Utah Inland Port Authority Board meeting in 2019.

Hamilton County Judge Ted Berry on Charlie Kirk assassination: ‘How’s he feel about gun violence & gun control in Hell, now?’

 

Hamilton County Municipal Court Judge Ted Berry is facing increasing calls to resign and has been removed from an advisory post at the Joe Burrow Foundation after social media comments that critics say celebrated the assassination of conservative activist Charlie Kirk.

 

Local and state officials called the remarks, which included language such as “Rest in Hatred & Division,” incompatible with the duties and ethical obligations of a sitting judge.

 

On Friday, state Rep. Adam Mathews, R-Lebanon, demanded Berry’s immediate resignation, describing the offending posts as “vitriolic, racially charged, and political language” that violated the Ohio Code of Judicial Conduct.

 

“A judge must be a pillar of fairness and impartiality in our community,” Mathews said in a statement. “To see a sitting judge post comments like ‘Rest in Hatred & Division!’, ask ‘How’s he feel about gun violence & gun control in Hell, now?’, and then celebrate the race of the killer by stating ‘So, a white guy killed him! Color it KARMA!’ is shocking and completely unacceptable. This is not the conduct of a neutral arbiter of the law; it is the behavior of a political activist who has abandoned the core principles of his office.”

 

The Joe Burrow Foundation issued a brief statement saying it had “terminated an advisory board member that made inappropriate remarks in light of recent events and they are no longer associated with the Foundation.”

 

“Their comments do not reflect our values or our mission,” the group added in its statement. The foundation did not name Berry in its public notice, but local outlets reported he was the member removed.

 

Presiding and administrative Judge Josh Berkowitz emphasized the formal process for assessing judicial misconduct.

 

“Judges are bound by the Ohio Code of Judicial Conduct at all times. Violations are investigated by the Office of Disciplinary Council. It’s a serious process,” Berkowitz said, per Fox 19, noting the Ohio Supreme Court can ultimately impose sanctions.

 

Berry provided a short statement to local reporters that stopped short of a retraction. He told The Enquirer that he does not “condone any type of violence on any human being.”

 

“I regret if I caused division,” he added. “That was not my intent. And I hope there can be peace.”

 

Critics say the expressed regret does not address the substance of the posted comments or their effect on public confidence in the judiciary.

 

Hamilton County Democratic Party Chairman Alex Linser told Fox 19 Berry will no longer be recognized at the party’s upcoming judicial reception and called the comments “disappointing and divisive.” He warned against increasing inflammatory rhetoric that “further divides our country.”

 

This latest controversy swirling around Judge Berry revives awareness of earlier disciplinary actions taken to rein in distasteful behavior from him.

 

State Rep. Brian Stewart, R-Ashville, blasted Berry for his comments.

 

“In 2021, this Judge Ted Berry admitted to a ton of vulgar, sexually inappropriate conduct with a court employee,” Stewart said in a post to X. “The Maureen O’Connor-led Supreme Court gave him a 6 month suspension – but stayed it! He didn’t lose his license for 1 single day. Slap on the wrist.”

 

Mathews “is 100% right – this judge needs to resign, and if he won’t, Disciplinary Counsel should get involved,” Stewart added.

 

Legal and ethics experts say the Office of Disciplinary Council is likely to consider whether the posts created an appearance of bias under Canon 2 of the Ohio Code of Judicial Conduct, and whether public comments require recusal from pending or future matters. If a formal grievance is filed, the process typically includes an intake review and can lead to investigatory proceedings.

 

The Office of Disciplinary Council has not announced any action. Mathews has already said he is preparing to file a formal grievance if Berry does not resign.
