Domestic Enemy to the Constitution of the United States unlawfully detains man for verbally opposing and challenging his actions of unlawfully searching a man. Cop also tells him to shut his mouth.
The US Supreme Court said in 1987 in their 8-1 majority opinion in City of Houston v Hill that the "freedom of individuals verbally to oppose or challenge police action without thereby risking arrest is a principle characteristic from which we determine a free nation from a police state".
Detaining him and threatening arrest for such is a violation of his 1st and 4th amendment rights. The order to "get back" was unlawful and served no legitimate purpose but to infringe upon the mans right to oppose and record his actions. Arizona tried setting a minimum distance in law of just 8 feet and it was ruled unconstitutional as it served no legitimate purpose.
Any police officer telling someone to "shut your mouth" or similar is a violation of the 1st amendment. It is meant to intimidate someone into ceding their 1st amendment right to speak, which no officer has the right to demand.
