We're not at war, and military can not violate the constitution simply because they do not recognize it, or the peoples, authority over even POTUS. If the military does not recognize that, they are enemies to the constitution and should be dealt with accordingly.

Notice which is first? The Constitution.
When the president gives an illegal order, the constitution takes precedence. When the court exercises checks and balances, the president does not have authority to "overrule" them and issue a then unconstitutional order, and the military oath is to the constitution FIRST.
