A federal agency doesn't need to be in the constitution. They have authority to create agencies, they do not have authority to criminalize possession of a substance. What you're doing is misdirection.
Every single member of law enforcement, prosecutor, judge, etc involved in prosecuting someone for possession has violating rights under color of law and 18 USC 242.
Same for gun control, roadside civil asset forfeiture, prior restraint, etc. The list goes on and on.
Perhaps you're waiting for the wrong thing.
