Luigi Mangione’s Lawyers Are Trying to Get His Case Thrown Out

 

Luigi Mangione, accused of shooting UnitedHealthcare CEO Brian Thompson outside a Manhattan hotel last December, is entering a crucial week-long pretrial hearing in New York state court.

 

The hearing will focus on whether the evidence collected against him was obtained legally and if his statements to police violated his constitutional rights.

 

Mangione’s defense is pushing hard to have key evidence, including a red notebook described by authorities as a “manifesto,” tossed out, arguing the items were seized after an illegal search and that he was interrogated without Miranda warnings.

 

“The hearing could last at least a week. Marc Agnifilo, one of Mangione’s attorneys, said he expects prosecutors to call as many as 28 witnesses — including some from Altoona, Pennsylvania, where Mangione was apprehended last December at a McDonald’s restaurant days after the shooting,” reports NBC News.

 

“The proceedings are set to be divided into two sections. Both will focus on whether any evidence or statements were obtained illegally and should be excluded from trial.”

 

Judge Gregory Carro is overseeing the two-stage pretrial process:

 

In the first part, known as a Mapp hearing, Carro will hear testimony and arguments before deciding whether the police had a legal right to obtain physical evidence.

In the second, known as a Huntley hearing, Carro will review evidence before ruling whether statements Mangione made to law enforcement were coerced or obtained in violation of his rights.

 

Carro’s rulings will determine the extent of evidence the prosecution can present at trial, and could potentially make or break the case against Mangione.

 

Karen Agnifilo, another Mangione attorney, said the defense is not expecting a third section known as a Mosley hearing, which focuses on whether a non-eyewitness can testify about whether a person in a video or photo is Mangione.

 

Mangione has pleaded not guilty to nine state charges and four separate federal counts, the latter carrying the possibility of the death penalty.

 

The defense claims police conducted a warrantless search of Mangione’s backpack at a McDonald’s in Altoona, Pennsylvania, where he was arrested days after the shooting.

 

They argue this search violated the Fourth Amendment, making any evidence recovered—including a 3D-printed ghost gun, fake IDs, ammunition, and his writings—inadmissible.

 

They also contend that officers failed to promptly read Mangione his Miranda rights, questioned him without informing him of his right to remain silent, and thereby violated his Fifth Amendment protections. The defense attorney Karen Agnifolo stressed the prejudice caused by the “manifesto” label and improper police procedures in detaining and interrogating Mangione.

 

“Law enforcement has methodically and purposefully trampled his constitutional rights by interrogating him without Miranda warnings in violation of the Fifth Amendment and illegally searching his property without a warrant in violation of the Fourth Amendment,” Agnifilo claimed in a statement.

 

Prosecutors claim Mangione planned the attack by traveling to New York, stalking Thompson, and killing him. Ammunition at the scene was engraved with words like “delay,” “deny,” and “depose,” reflecting grievances against the healthcare industry found in Mangione’s writings. Surveillance footage, including a viral shooting video, captured Mangione’s movements before and after the assassination. The prosecution intends to use this evidence to secure a conviction in what is expected to be a high-profile trial.

 

Mangione became something of a celebrity on the political left after his capture. Saturday Night Live’s audience even applauded at the mere mention of him. Back in February, CNN’s Kaitlan Collins casually shared Mangione’s legal defense site on social media. In June, a musical about Mangione opened in San Francisco.

 

The coming days will reveal whether prosecutors can keep their case intact or whether the defense’s sweeping claims of constitutional abuse gain traction, but the stakes stretch far beyond the courtroom.

Bill Gates, the Microsoft co-founder reinvented himself as a creepy advocate for climate alarmism and other leftist causes, recently stated that he would support the deployment of artificial “geoengineering” technologies to reduce global temperatures by reflecting the Sun’s radiation if the climate reached a “tipping point.” Just over a month ago, Gates backtracked on climate alarmism by pushing back on what he calls the “doomsday outlook.”

 

In a recent interview with Axios, Bill Gates expressed his views on the controversial topic of solar geoengineering, a subset of technologies aimed at cooling the planet by reflecting sunlight back into space. Gates is a major funder of research into these technologies.

 

Gates emphasized that the world is largely on track to avoid the worst climate impacts, thanks to the increasing adoption of clean energy solutions. However, he also acknowledged the possibility of especially dire consequences driven by climate tipping points, scenarios in which warming triggers reinforcing feedbacks or secondary effects that accelerate climate change. Using statistical projections, they estimated a death toll far surpassing the official figure. The study applied established demographic methods to forecast what normal mortality rates would have been without the conflict, creating a "counterfactual scenario" to measure the war's full impact.

 

Crucially, the report refutes persistent claims by Israeli officials that Gaza’s Health Ministry, which is the primary source for casualty figures, inflates its numbers. The German researchers found no evidence of statistical manipulation.

 

On the contrary, they concluded that the ministry’s count, which currently stands at 72,500, has been conservative. The study attributes the difficulty in achieving an accurate count to the systematic destruction of Gaza's medical sector by Israeli forces, which has created a severe lack of resources for documenting the dead.

The DHS said that the migrants are being protected by New York's sanctuary laws, which limit local law enforcement cooperation with immigration agents.

 

The Department of Homeland Security sent a letter Monday to New York Attorney General Letitia James, demanding that she turn over the more than 7,000 illegal migrants that are allegedly locked up in jails and prisons in the state.

 

Acting Immigration and Customs Enforcement Director Todd Lyons claimed that nearly 7,000 illegal migrants, who had active detainers because they allegedly committed thousands of crimes, were released back into the state since January and 7,113 illegal migrants with active ICE detainers are currently locked up in New York, according to the New York Post.

 

“These are people who are not only in the country illegally, but who have committed additional crimes, including heinous crimes like murder, rape, possession of child pornography, armed robbery, and many others," Lyons wrote.

 

The DHS said that the migrants are being protected by New York's sanctuary laws, which limit local law enforcement cooperation with immigration agents.

 

The department also said the 7,113 illegal migrants are allegedly responsible for a combined 148 homicides, 717 assaults, 134 burglaries, 106 robberies, 235 dangerous drug offenses, 152 weapons offenses and 260 sexual predatory offenses.

 

“Virtually all Americans agree that people like this should be swiftly removed from the United States when they leave New York’s custody and not be returned to our streets to wreak havoc on law abiding citizens,” Lyons said.

Scare at Mar-a-Lago after yet another plane violates airspace, causing F-16 fighter jets to scramble

 

Pilots are warned about airspace restrictions through notices from the FAA.

 

A civilian aircraft violated the restricted airspace above Mar-a-Lago in Palm Beach on Saturday, according to military officials.

 

Two F-16 fighter jets scrambled to respond to the plane at about 4:20 p.m., and flares were also fired to get the pilot's attention, according to the North American Aerospace Defense Command.

 

'Adherence to [temporary flight restriction] procedures is essential to ensure flight safety, national security, and the security of the president.'

 

The aircraft was escorted out of the restriction zone.

 

"The flares, which may have been visible to the public, are used with the highest regard for safety, burn out quickly and completely, and pose no danger to people on the ground," read a statement from NORAD.

 

NORAD said that there had been multiple violations of the restricted airspace by "general aviation aircraft" earlier in the week.

 

The temporary flight restrictions are issued by the Federal Aviation Administration whenever the president is visiting his residence in Florida. When a violation is detected, air traffic controllers warn pilots, and fighter jets are scrambled to intercept planes if they do not respond.

 

There have been about 40 instances of airspace violations near Mar-a-Lago since Trump took office in January, NORAD says.

 

After one violation in March, NORAD commander Gen. Gregory Guillot expressed frustration that pilots aren't attentive enough to the alerts about avoiding restricted airspace, called NOTAMs.

 

"Adherence to [temporary flight restriction] procedures is essential to ensure flight safety, national security, and the security of the president," said Guillot in a statement at the time. "The procedures are not optional."

 

"Trust us on this … you don't want to spend your Thanksgiving explaining to the #FAA or local law enforcement that you didn't check your NOTAMs," read a statement from NORAD on Wednesday. "#NORAD has already escorted one general aviation pilot out of the #FAA restricted airspace near Palm Beach today. Don't be next, check NOTAMs before every flight."

 

NORAD is a joint organization between Canadian and U.S. forces to monitor and defend North American airspace. It was first established in 1957 and includes high-ranking members of the Royal Canadian Air Force as well as the U.S. Air Force.
