Department of Justice Rule Restores Equal Protection for All in Civil Rights Enforcement

Today, the Justice Department issued a final rule updating its regulations under Title VI of the Civil Rights of 1964. This rule ensures that our nation’s federal civil rights laws are firmly grounded in the principle of equal treatment under the law by eliminating disparate-impact liability from its Title VI regulations.
“For decades, the Justice Department has used disparate-impact liability to undermine the constitutional principle that all Americans must be treated equally under the law,” said Attorney General Pamela Bondi. “No longer. This Department of Justice is eliminating its regulations that for far too long required recipients of federal funding to make decisions based on race.”
“The prior ‘disparate impact’ regulations encouraged people to file lawsuits challenging racially neutral policies, without evidence of intentional discrimination,” said Assistant Attorney General Harmeet K. Dhillon of the Justice Department’s Civil Rights Division.“Our rejection of this theory will restore true equality under the law by requiring proof of actual discrimination, rather than enforcing race- or sex-based quotas or assumptions.”
“For over 50 years, the prior disparate-impact rule fostered the very thing the Civil Rights Act of 1964 prohibited — discrimination on the basis of race, color, or national origin. But with today’s rule,” said Chief of Staff and Supervisory Official for the Office of Legal Policy Nicholas Schilling. “The Department reaffirms Congress’ commitment to measure all Americans by merit.”
Congress enacted Title VI, 42 U.S.C. § 2000d, as part of the landmark Civil Rights Act of 1964. It prohibits discrimination on the basis of race, color, and national origin in programs and activities receiving Federal financial assistance. In 1973, the federal government added to the law a new rule — disparate impact — that was not part of the law. The term “disparate impact” refers to the concept of imposing liability on a federal fund recipient only because there may be different outcomes for different people, not based on prejudice or intent. That prior disparate-impact rule was already enjoined in one state, prohibiting DOJ from enforcing it there.
The Department’s new rule reflects the best reading of Title VI, as the Supreme Court has repeatedly recognized for over twenty years. Title VI has and will continue to prohibit intentional discrimination. The Department’s new rule ensures that recipients of federal funding will be judged on their actual conduct, not on statistical outcomes or circumstances beyond their control.
Despite decades of case law, the Department’s prior Title VI disparate-impact regulations remained on the books, sowing confusion and creating costly compliance obligations for states, local governments, nonprofits, and private organizations receiving federal financial assistance. This new rule eliminates these burdens, promotes consistent enforcement across agencies, and restores public confidence in civil rights law by aligning the Department’s regulations with the Constitution.

Department of Justice Leadership Announces New Personnel Appointments and Authorizations in the District of New Jersey
Today, following Attorney General Pamela Bondi's announcement thatAlina Habba will serve as Senior Advisor to the Attorney Generalfor United States Attorneys, Deputy Attorney General Todd Blanche announced the following personnel appointments and authorizations within the District of New Jersey:
Philip Lamparello will serve as Senior Counsel and is authorized to supervise or conduct the work of the district’s Criminal Division and Special Prosecutions Division, including such work in the district’s branch offices;
Jordan Fox will serve as Special Attorney and is authorized to supervise or conduct the work of the district’s Civil Division and Appellate Division, including such work in the district’s branch offices, along with any other matters arising within the district not specifically delegated herein; and
Ari Fontecchio will serve as Executive Assistant United States Attorney and is authorized to supervise or conduct the work of the district’s Administrative Division, along with any other administrative matters arising within the district.

New Jersey twins charged in threats to kill DHS official, ‘shoot ICE on sight’
New Jersey suspects allegedly posted medieval torture threats against DHS assistant secretary Tricia McLaughlin on social media
Two New Jersey brothers were arrested Tuesday on charges tied to terroristic threats against DHS chief Kristi Noem’s top public-facing deputy, including alleged vows to "shoot ICE agents on sight." One brother also faces unlawful weapons-possession charges.
The harrowing allegations come amid a reported 8,000% increase in death threats against Immigration and Customs Enforcement personnel. The alleged targeting of Assistant Secretary Tricia McLaughlin presented a new danger for those working to realize President Donald Trump’s mass deportation of the "worst of the worst" illegal immigrant criminals.
Ricardo Antonio Roman-Flores and Emilio Roman-Flores, twins from Absecon, New Jersey, next to Atlantic City; were arrested after allegedly posting to X that they wanted to torture and kill McLaughlin in a medieval fashion.
"We Americans should find you, tar you, feather you, and hang you as we did to anyone serving tyrants before the Revolutionary War."
A second partially redacted tweet, reportedly from the other brother, read: "Shoot ICE on sight."
Seen as Noem’s top representative in the press, McLaughlin has not been shy about defending her agency, recently lambasting those like the Absecon brothers who allegedly threaten ICE agents as "despicable" and repeating that attacks on federal officers are a direct result of violent rhetoric from Democrats and the political left.
She has also criticized far-left city leaders like Chicago Mayor Brandon Johnson, who has stood up against DHS operations.
ICE Director Todd Lyons told Fox News Digital the swift arrests — within three days of the alleged threats — serve as a warning.

Children locked up, starved and beaten in meth-filled Missouri house of horrors
A mother and father are accused of locking up, beating and starving their three children in an “uninhabitable” meth-filled and urine-soaked home.
Amberly Britton and Mark Myers, of O’Fallon, Missouri, were visited by authorities at the house of horrors after they failed to respond to school officials when one of the children showed up to school with a massive gash months ago, according to charging documents obtained by KMOV.
Inside, the kitchen cabinets and the refrigerator were locked shut, and investigators with the Missouri Department of Social Services later learned that the children were denied regular access to food.
The house reeked of urine and was completely unsanitary, according to police, who described the home as “uninhabitable.”
There was also no working heat and no bedding on any of the mattresses, cops noted.
One of the children, a 13-year-old girl, told investigators she was in pain and had vomited from severe hunger — and was beaten afterwards.
Police also discovered a large amount of methamphetamine in the house.
“During multiple visits, the adults appeared evasive, impaired, or unresponsive and repeatedly claimed to be unable to complete drug testing after investigators received information that methamphetamine was being used inside the residence,” the probable cause statements say.
“Despite being given an opportunity to clean and correct safety hazards, no meaningful improvements were made.”
Both Britton and Myers “blamed” their children for the abuse and state of the homeand showed no remorse, according to investigators.

The widow of a Big Apple cabbie who was mugged by one of Zohran Mamdani’s newly named advisers and his crew nearly three decades ago was appalled by the lefty mayor-elect’s decision Tuesday.
“Are you crazy?” the Bronx woman, whose husband Joseph Eziri died last year, said when she learned thatMamdani had tapped convict-turned-activist Mysonne Linen to sit on his mayoral transition’s “criminal legal system” committee.

“Please … To me, he is no good. Why do you give him a position like that?”
Linen, 49, was among 400 New Yorkers officially appointed last month to the 20-member criminal justice panel, one of 17 committees picked to help the democratic socialist Queens assemblyman make the transition to New York City mayor.
But the Bronx native, a former promising aspiring rapper, landed on the wrong end of the legal system when he was sent to state prison in 1999 for seven years for being part of a vicious armed robbery crew, according to reports.
