Federal Judge Bars Trump Admin's Funding Cuts To Sanctuary States

A federal judge in Rhode Island has blocked the Trump administration’s plan to divert Homeland Security funding from states that fail to assist with certain federal immigration efforts.

U.S. District Judge Mary McElroy’s ruling on Monday sided with a coalition of 12 attorneys general that sued the administration this year after being informed that several states would receive reduced federal grants as a result of their sanctuary jurisdiction statuses.

The order affects funding from the U.S. Department of Homeland Security (DHS) and the Federal Emergency Management Agency (FEMA), which had cut more than $233 million from Connecticut, Delaware, the District of Columbia, Massachusetts, Minnesota, New York, Rhode Island, Vermont, and Washington. These funds are part of a $1 billion program tied to risk assessments and primarily go to local law enforcement and emergency services.

The group of a dozen attorneys general included those from California, Illinois, and New Jersey, who all wanted to participate in challenging the legality of the Trump administration’s policy.

In her 48-page ruling, McElroy ruled that the government’s funding decisions wrongly took into consideration states’ positions on immigration enforcement.

“What else could defendants’ decisions to cut funding to specific counterterrorism programming by conspicuous round numbered amounts—including by slashing off the millions-place digits of awarded sums—be if not arbitrary and capricious? Neither a law degree nor a degree in mathematics is required to deduce that no plausible, rational formula could produce this result,” McElroy wrote.

The judge then ordered DHS to reinstate the previously announced funding allocations to the plaintiff states.

Federal Judge Upholds New York's Driver's Licenses For Illegals

A federal judge on Tuesday dismissed the Trump administration’s challenge to New York’s Green Light Law, upholding the state’s issuance of driver’s licenses to individuals without requiring proof of legal U.S. residency.

U.S. District Judge Anne M. Nardacci (Biden) in Albany determined that the Trump administration, which challenged the law under President Donald Trump’s enforcement of immigration laws, failed to back its claims that the state law usurps federal law or that it unlawfully regulates or unlawfully discriminates against the federal government.

The Justice Department filed the lawsuit against the state over the law in February, naming Gov. Kathy Hochul and the state’s attorney general, Letitia James, as defendants.

“As I said from the start, our laws protect the rights of all New Yorkers and keep our communities safe,” James said in a statement on Dec. 19. “I will always stand up for New Yorkers and the rule of law.”

Nardacci stated that her job was not to evaluate the desirability of the Green Light Law as a policy matter. Rather, she said in a 23-page opinion, it was to assess whether the Trump administration’s arguments established that the law violates the U.S. Constitution’s Supremacy Clause, which grants federal laws precedence over state laws.

The administration, she wrote, has “failed to state such a claim.”

Judge Puts Stop To Food Dye Ban Championed By RFK Jr.

A federal judge granted on Tuesday a preliminary injunction order that would prevent the enforcement of parts of West Virginia’s H.B. 2354, which takes aim at artificial food dyes.

U.S. District Judge Irene Berger of the Southern District of West Virginia entered the preliminary injunction order Tuesday, according to WV Metro News. According to the order, the International Association of Color Manufacturers (IACM) sought to prevent the enforcement of West Virginia’s H.B. 2354, as it amended Section 16-7-2(b)(7) to include seven color additives that are “poisonous and injurious” as ingredients or substances.

The seven color additives named are butylated hydroxyanisole, propylparaben, FD&C Blue No. 1, FD&C Blue No. 2, FD&C Green No. 3, FD&C Red No. 3, FD&C Red No. 40, FD&C Yellow No. 5, and FD&C Yellow No. 6.

H.B. 2354 also added a provision, Section 18-5D-3A, prohibiting these color additives “as an ingredient in any meal served in a school nutrition program,” with the exception of school fundraising events on or away from campus occurring “at least one half-hour after the end of the school day,” according to the order.

The IACM argued H.B. 2354 violates the Equal Protection Clause by singling out manufacturers and fails a rational basis review by not providing any factual findings stating why the color additives named in Section 16-7-2(b)(7) are unsafe, according to the same order. The IACM also said H.B. 2354 is “unconstitutionally vague” by not defining “poisonous and injurious,” and leaves the door open for “arbitrary enforcement.”

19 States Sue HHS for Blocking Sex-Rejecting Procedures for Minors

As many as 19 states along with the District of Columbia have sued the U.S. Department of Health and Human Services (HHS) after its secretary Robert F. Kennedy Jr. issued a declaration blocking medical professionals from administering sex-rejecting procedures to minors.

As Breitbart News reported last week, the Trump administration announced “six decisive actions” against doctors administering transition treatment to minors under the president’s order to “end the practice of sex-rejecting procedures on children that expose young people to irreversible harm.”

“The doctors assume a solemn obligation to protect children. Doctors across the country now provide needless and irreversible sex-rejecting procedures that violate their sacred Hippocratic oath, endangering the very lives that they are sworn to safeguard,” Kennedy said during the announcement.

“The American Medical Association, the American Academy of Pediatrics, peddled a lie that chemical and surgical sex-rejecting procedures could be good for children who suffer from gender dysphoria,” he added, further accusing them of betraying “the estimated 300,000 American youth ages 13 to 17 conditioned to believe that sex can be changed.”

VOTERGA FILES EMERGENCY FEDERAL SUIT TO VACATE DOMINION CERTIFICATION IN GEORGIA

VoterGA announced today it has filed an emergency federal complaint intended to force the U.S. Election Assistance Commission (EAC) to vacate the 2019 certification of the Dominion Democracy Suite 5.5-A (DDS 5.5A) voting system currently used in Georgia. The complaint is based on unrefuted expert witness testimony showing the voting system does not meet, and never met, 2005 EAC security requirements that formed the basis to certify the system in 2019.

The complaint comes on the heels of a similar petition to the EAC. The EAC agreed to take the petition into consideration but declined to provide any permanent or interim relief stating their procedures would not let them do so. VoterGA sought interim relief to postpone the original certification until such time it can be permanently vacated. Their request was based on federal law that states: “When an agency finds that justice so requires, it may postpone the effective date of action taken by it, pending judicial review.” 5 U.S.C. § 505

VoterGA is joined by the original state petitioners, the Dekalb County Republican Party, as well as the Chatham County Republican Party and individual petitioners Richard J. Armstrong and VoterGA co-founder Garland Favorito. The case was filed in the U.S. Southern District of Georgia by attorneys Jonathan Miller and Harry MacDougald.

Voters in other states have also filed similar petitions after learning the experts testified that all Dominion Democracy Suite 5 systems have severe vulnerabilities largely identical to those discovered in the Georgia DDS 5.5A system. Voters in California, Arizona, Wisconsin, Michigan, Florida, Pennsylvania and Colorado have indicated they filed similar EAC claims.

After analyzing an authenticated copy of a Georgia 2020 election server, experts Ben Cotton and Clay Parikh testified in the September 30, 2024 Dekalb GOP v. Raffensperger hearing that Georgia’s Dominion system uses unchanged hard coded passwords and does not store encryption keys in an encryption module as required by 2005 Voluntary Voting System Guidelines Volume 1 which are mandated for EAC certification.

Favorito explained how their expert testimony showed the systems are interconnected and accessible worldwide through a “back door” facilitated by the password and encryption vulnerabilities. He stressed the urgent need for immediate court action and concluded: “We have a national security crisis that must be resolved before the 2026 primaries”.

If your brain just tried to file “NGO” under soup kitchens and service dogs, congratulations, you have the same mental model the tax code is still using.

The point is not that charity is bad, because plenty of nonprofits do real, direct help.

The point is that a legal structure built for modest charities now covers universities, hospital systems, foundations, and advocacy groups sitting on Wall Street sized portfolios.

A corporation with that kind of balance sheet would live under constant disclosure, regulation, and taxation.

A state with that kind of power would face elections and public law.

But this sector sits in a sweet spot: private, tax exempt, and often politically active without being formally partisan.

The economic distortion is easy to picture with two hospitals across the street charging similar rates, while the for profit pays corporate taxes and the nonprofit often does not.

That “savings” does not evaporate, since it gets shifted onto patients, taxpayers, or competitors.

And it gets spicier, because today’s NGO world is also a political machine, with money moving through linked 501(c)(3) and 501(c)(4) structures to fund litigation, advocacy, and pressure campaigns.

It all points to George Soros, his son Alex, and the Open Society Foundations as an example of how tax advantaged capital can be used for long running political influence.

The proposed fix is not burning down civil society, but updating the rules by protecting true direct service charities while taxing business like income, tightening rules for giant endowments, and pulling exemptions from sustained political activism.
