Community Opportunity to Purchase Act

The Council approved the Community Opportunity to Purchase Act, legislation that would allow community land trusts to purchase properties before they go for sale on the open market 31 to 10. Three councilmembers were absent for the Dec. 18 meeting and seven abstained from the vote.

Councilwoman Sandy Nurse (D-Brooklyn) is the lead sponsor of COPA, also known as Intro. 0902-B.

The bill was introduced May 16, 2024 and heard by the Council Committee on Housing and Building June 3.

Councilwomen Joann Ariola (R-Ozone Park) and Vickie Paladino (R-Whitestone) and Councilmen Jim Gennaro (D-Fresh Meadows) and Bob Holden (D-Maspeth) were the members from Queens who voted against the bill.

“Yesterday, at the stated meeting, I spoke out against the blatant infringement on individual homeowners’ property rights under the COPA Act,” Paladino said in a Facebook post on Dec. 19. “‘Outrageous’ doesn’t even begin to describe it. Government overreach is an understatement.”

Mayor Adams’ office said he was not in support of the bill and other progressive housing legislation that were passed.

“The Council passed a suite of housing bills today that will add red tape, drive up rents and deplete critical city resources at a time when our housing budget faces significant threats from the federal government,” said Fabien Levy, the mayor’s spokesman, in a statement.

Ann Korchak, board president of Small Property Owners of New York, shared the same sentiment as Adams’ office.

“COPA will make New York City an affordable housing wasteland and trigger the extinction of small owners,” said Korchak in a statement. “This government-engineered, socialist scheme sanctions politically-connected, nonprofit housing slumlords and predatory developers to snatch private property …”
