As the brave people of Iran continue to fight for their basic rights, the Iranian regime has responded with violence and cruel repression against its own people.

 

In response, the United States is designating the notorious Fardis Prison, an institution where women have endured cruel, inhuman, and degrading treatment.

 

Simultaneously, the Department of the Treasury is sanctioning several Iranian security officials, including Ali Larijani, the Secretary of the Supreme Council for National Security (SCNS). Additionally, Treasury is designating 18 individuals and entities tied to Iran’s “shadow banking” networks that have laundered proceeds from Iranian petroleum and petrochemical sales. This action also further implements National Security Presidential Memorandum-2 of 2025.

 

The United States stands with the Iranian people, who are protesting for their natural rights. The regime continues to fund destabilizing and malign activities around the world, rather than investing in the welfare of its people at home. We will continue to deny the regime access to financial networks and the global banking system while it continues to oppress the Iranian people.

 

Today’s actions are being taken pursuant to Executive Order (E.O.) 13553, which authorizes sanctions on certain persons with respect to serious human rights abuses by the Government of Iran; E.O. 13876, which authorizes sanctions on the Supreme Leader of Iran and his affiliates; E.O. 13902, which targets Iran’s financial, petroleum, and petrochemical sectors; and the Countering America’s Adversaries Through Sanctions Act. The Justice Department’s Office of Legal Counsel just ruled that Section 1715 of Title 18 is unconstitutional as applied to constitutionally protected firearms, including handguns.

 

This Section covers the interstate shipping of firearms through the Post Office.

 

A pro-gun DOJ does not blindly enforce bad law. It applies the Second Amendment and the Bruen ruling, identifies unconstitutional gun control, and refuses to carry it out.

For dummies like me. On January 15, 2026, the Department of Justice’s Office of Legal Counsel issued a major opinion declaring 18 U.S.C. § 1715 unconstitutional when applied to typical handguns and other protected firearms.

 

This nearly 100-year-old law (from 1927) bans mailing concealable firearms—like pistols and revolvers—through the U.S. Postal Service. It was created during the Prohibition era to stop criminals from easily shipping guns across states.

 

The opinion relies on the Supreme Court’s 2022 Bruen decision, which requires gun laws to match historical traditions from the Founding era (late 1700s). Lawyers reviewed old records and found no similar ban on mailing firearms back then, so the modern restriction fails the test. They also called the law’s goal—reducing “traffic” in concealable guns—illegitimate under today’s Second Amendment standards.

 

The law stays on the books (Congress would need to repeal it), but the DOJ now says it won’t enforce the ban against mailing constitutionally protected firearms. This means law-abiding people can ship handguns via USPS (following safety/packaging rules) without federal prosecution risk.

 

It’s a significant pro-Second Amendment move by the current DOJ and could spark challenges to other old gun restrictions.
