No, the tenth amendment protects police powers with probable cause. If someone is clearly trying to run a police officer over, well, no explanation required.

 

If you were just born out of the womb and a police officer arrests the newborn, that is not probable cause, that's kidnapping.

Yes, the government does have that authority, It is not criminal immediately, but based on how the trial goes with congress.
