Can You Go to Jail for What You Post Online in Australia?

The Australian government is rushing through new hate speech laws under the " Exposure Draft Legislation: Combatting Antisemitism, Hate and Extremism Bill 2026" omnibus bill, that could criminalise things you say online, at work, and even in private chats. Most Australians will not realise what has changed until it is too late.

As a lawyer, former police officer, and former prosecutor, I am sounding the alarm because this legislation is vague, rushed, and dangerous.

In this video, I break down:

How the new hate speech offences actually work

Why the definition of โ€œpublicly promoting hatredโ€ is far broader than people think

How intent is removed from the offence and replaced with someone elseโ€™s feelings

Why this lowers the threshold to charge people under Commonwealth criminal law

How social media posts, comments, jokes, and work chats could trigger investigations

The real risk to your job, your visa, and your freedom of speech

Why this Bill was rushed through Parliament with almost no public consultation

The loopholes and omissions buried in the fine print that most media coverage has missed

This law was introduced in response to the Bondi tragedy, but major laws affecting fundamental rights should not be passed in 48 hours without proper scrutiny.

Australia does not have a Bill of Rights or constitutional free speech protections. Once this law passes, it is the law. That is why understanding the details matters.

This video is not about politics.

It is about how the law actually works, what prosecutors look for, and why vague criminal thresholds create chilling effects across society.

If you use social media, work in an office, engage in political debate, or are not an Australian citizen, this directly affects you.

Watch before you dismiss it.
