Because they could never justify it logically.

And it would be a violation of oath to draft or argue for it.

The Executive branch enforces laws that are on the books.

The Legislative branch passes laws to protect the Country.

Currently, the Legislative branch has the power to change the laws. They won't. They just blame the Executive, which has only enforcement authority.
