Supreme Court says internet service provider isn’t liable for bootlegged music downloads(1/2)

In amajor loss for the nation’s music industry, the Supreme Court on Wednesday ruled On behalf that amajor internet service provider is not liable for copyright infringementbecause itfailed to kick known copyright violators off its network.

 

Justice Clarence Thomas wrote the opinion for a unanimous court.

 

The nation’s largest record labels want to hold internet providers liable for copyright infringement because they declined to cut off online access to users they know are downloading bootlegged music.

 

Themusic companies hold the rightsto many of America’s mostrecognizable singers and songwriters, including Bob Dylan, Bruce Springsteen, Beyoncé, Eminem, Eric Clapton and Gloria Estefan.

 

“Under our precedents,a company is not liable as a copyright infringer for merely providing a service to the general publicwith.knowledge that it will be used by some to infringe copyrights,” Thomas wrote.

 

A jury initially awarded Sony Music Entertainment and other record companies a $1 billion verdict against Cox Communications for the infringement of more than 10,000 copyrighted works. While a federal appeals court nixed that award, it nevertheless held that Cox could be held indirectly liable for contributing to infringement on a massive scale.

 

Cox had warned of cataclysmic consequences for internet users if Sony got its way. For one thing, it said,institutional customers like universities and hospitals could be entirely cut off from the internet if only a few users on their campuses were downloading pirated music==. At oral arguments in early December, that position seemed to resonate with both conservative and liberal justices.

 

Sony, Universal Music Corp. and other companiesrepresenting 80% of the music industry suedin 2018. A jury in Virginia found thatCox was liable for both vicarious infringement— meaning it benefited financially from it —and contributory infringement. The Richmond-based 4th US CircuitCourt of Appeals reversed part of that decision, on vicarious liability, and required the district court to reconsider the $1 billion verdict.

 

But the appealscourt upheld the contributory infringement decision, noting that themusic industry had flooded Cox with infringement noticesfrom 2013 to 2014 and thatthe company only terminated 32 customers for copyright infringement. It had, at the same time,terminated hundreds of thousands of subscribers for nonpayment. The appeals court ordered a new trial to reassess the size of the award.

 

The evidence at trial, viewed in the lightmost favorable to Sony, showedmore than mere failure to prevent infringement,” the appeals court wrote.

 

The jury saw evidence that Cox knew of specific instances of repeat copyright infringement occurring on its network, thatCox traced those instances. tospecific users, and that Coxchose to continue providing monthly internet accessto thoseusers despitebelieving the online infringement would continuebecause it wanted to avoid losing revenue.

Latest ruling declining to hold companies liable

 

The Supreme Courthas declined to hold companies liable for aiding and abetting in other recent civil damages cases.

 

Last year, a unanimous court ruledthat American gun manufacturers could not be held responsible for cartel violenceon the Southwest border, even though their guns are often involved in those crimes.

A mass text message sent to mobile users in Iranpromoted what it described as an“international campaign to reward the assassination of Trump,” according to screenshots of the message shared with Iran International.

 

The messageurges recipients to register their support through a websiteand to confirm participation by sending a number via SMS. It also directs users to further information on thedomestic platform Rubika.

 

The text included a link to thecampaign's website that could not be accessed from outside Iran.

 

Tehran-basedDidban Iran reported that the campaign has gained around 290,000 supporters, with total pledged amounts reaching $25 million.

 

The website says thatthese sums have not been collectedand instead represent pledged amounts, according to the report.

 

A statement on the site said thecampaign was launched following what it described as a jihad fatwaissued in response to thekilling of Iran’s supreme leader, and that it aimed to fund a reward for the assassin of US President Donald Trump.

Iran could open a new front in the Bab el-Mandeb Strait if attacks are carried out on its territory or islands, IRGC-affiliated Tasnim reported, citing an unnamed military source.

 

“If the Americans intend to take action regarding the Strait of Hormuz, they should be careful not to add another strait to their challenges… Iran is fully prepared to escalate the situation,” Tasnim quoted the source as saying.

Thai tanker safely transits Strait of Hormuz after talks with Iran

The tanker crossed the strategic waterway on Monday after successful talks between Thailand's foreign minister and Iran's ambassador to Thailand.

BANGKOK: A Thai oil tanker has safely passed through the Strait of Hormuz following diplomatic coordination between Thailand and Iran, and was not required to pay to escape the blockade, a Thai official and the oil major that owns the vessel said on Wednesday (Mar 25).

 

The Bangchak Corporation-owned tanker crossed the strategic waterway on Mondayafter successful talks between Thai foreign minister Sihasak Phuangketkeow and Iran's ambassador to Thailand.

 

"I requested that if Thai ships need to pass through the strait, could they assist in ensuring safe passage?" Sihasak told reporters late on Tuesday.

 

"They responded that they would take care of it and asked us to provide the names of the vessels that would be transiting."

 

The US-Israeli war against Iran has effectively cut off the delivery of about one-fifth of the world's oil and liquefied natural gas passing through the Strait of Hormuz, causing widespread disruption.

 

Since the conflict began on Feb 28,Thailand has faced soaring transportation costs and lengthening queues at its gas stations, despite assurances from the government that supplies remain sufficient.

 

The safe transit for the Thai tanker comes two weeks after the Thailand-flagged bulk carrier Mayuree Naree was attacked by a projectile in the strait, causing a fire onboard and forcing the crew to evacuate.

 

Iranian and Omani authorities have reached the vessel, but Thailand is still awaiting information on the status of three missing crew members, according to the Thai foreign ministry.

 

Another Thai vessel, owned by SCG Chemicals, is also awaiting clearance to transit the strait, Sihasak said.

In a statement, Bangchak said its vessel, which had been anchored in the Persian Gulf since Mar 11, was currently on its way back to Thailand. It gave credit to the coordination between Thailand's foreign ministry and Iranian authorities.

 

The company and a source in the Thai foreign ministry said no payment was involved.

 

Iran has told the United Nations Security Council and the International Maritime Organization that "non-hostile vessels" may transit the strait if ‌they coordinate with Iranian authorities, Reuters reported on Tuesday.

 

To secure the Bangchak tanker's transit, the Thai embassy in Muscat also worked with Omani authorities, coordinating alongside Iran via its embassy in Bangkok, the Thai foreign ministry source said, asking not to be named because of the sensitivity of the issue.

 

In a post on X, Iran's embassy in Thailand said that passage of the Thai ship reflected the close ties between the two countries.

 

"Friends have a special place," it said.

How the Iranian war may lead to the last days of the petrodollar

Accumulating dollars to pay for energy has underpinned the U.S. currency for decades

 

Oil exporting nations have typically recycled their petrodollars into U.S. Treasurys

 

One unintended consequence of the Middle East conflict may be the end of what is called the petrodollar regime.

 

The world saves in dollars largely because it pays for its energy in dollars. If the disruption caused by the effective closure of the Strait of Hormuz leads to major economies trading oil in other currencies then this could seriously undermine the dollar's hegemony in central bank reserves and global trade.

 

This warning was sounded by Deutsche Bank strategist, Mallika Sachdeva in a special report published Tuesday, subtitled "the perfect storm for the petrodollar." Deutsche Bank's views on the U.S. currency caused a controversy back in January when a note from its head of forex strategy, George Saravelos, provoked the ire of Treasury Secretary Scott Bessent.

 

If Bessent disapproved of those views then he's unlikely to look more favorably on the latest research in which Sachdeva argues that the dollar's dominance in cross-border commerce is arguably built on the petrodollar, and right now, these are flimsy foundations.

 

Oil is quoted in dollars, invoiced in dollars and settled in dollars, Sachdeva points out, and this practice dates back to an agreement struck between the U.S. and the Saudis back in 1974. The Desert Kingdom agreed to invest its trade surpluses in dollar assets in return for U.S. security guarantees, she writes, and those assets were generally U.S. Treasurys.

 

The dominance of the dollar in cross-border trade has a lot to do with the petrodollar.

 

As energy exporters accumulated dollar reserves, this allowed the U.S. to borrow extensively and cheaply, what former French president Valery Giscard d'Estaing called its "exorbitant privilege."

 

However, Sachdeva contends, the world is changing and most of the oil produced in the Middle East is sold to Asia, not America, which is now a net exporter itself. Sanctioned Iranian and Russian oil (producing between them roughly 13 million barrels of crude daily, around 14% of global consumption) has been trading "off the dollar rails," as Sachdeva puts it, for some time. The Saudis have been experimenting, she observes, with forms of non-dollar payment such as the Project mBridge infrastructure, using a central bank digital currency.

 

There were already signs of instability to petrodollar foundations: Saudi Arabia sells four times as much oil to China now as to the U.S.

 

Sachdeva is concerned that the regional escalation of the Gulf conflict may end up challenging assumptions about the security umbrella the U.S. provides, and may oblige some of these countries to unwind their savings in foreign assets. For example, Sachdeva notes that there are reported instances in the last few weeks of tankers being guaranteed safe transit through the strait should the payments be denominated in yuan (USDCNY).

 

Sachdeva writes: "The conflict could be remembered as a key catalyst for erosion in petrodollar dominance and the beginnings of the petroyuan."

 

A subsidiary consideration cited by Sachdeva is the possibility that as the world reduces its dependence on fossil fuels, perhaps to domestically available fuels, renewable energy and nuclear power, so the necessity of holding dollars may be reduced accordingly. "A world that becomes self-sufficient in defence and energy could also be a world that holds less dollar reserves."

 

The U.S. dollar index DXY has edged up 1% this year, with the greenback not getting its typical safe-haven bid as investors expect price in more rate hikes from foreign central banks including the European Central Bank than they expect from the U.S.

Lebanon army says Iranian-made missile exploded over territory

Lebanon’s army said on Wednesday that debris from an Iranian-made ballistic missile fell over a wide area of the country after it exploded at high altitude on March 24.

 

In a statement on X, the army said the missile was a “Qadr-110” with a range of about 2,000 km and likely targeted outside Lebanon.

 

It said the explosion was probably caused by a technical malfunction or an intercept, adding there were no interceptor missile systems inside Lebanon.

 

The army said it was continuing its investigation into the incident.
