Chief Justice Roberts Faces Two Strikes After New Leak Rocks The Court

 

The legendary baseball player and manager Ted Williams once wrote a letter to the Angels outfielder Jay Johnstone on improving his hitting. Among his pieces of advice was that “with two strikes, you simply have to protect the plate.”

 

Williams’s advice on not striking out came to mind this week when another leak of confidential information rocked the Supreme Court. (The prior leak of the Dobbs decision went unsolved). For Chief Justice John Roberts, the message is clear: it is a time like this when you have to protect the plate.

 

Roberts, of course, is famous for his own baseball analogies. In his confirmation, he declared that “judges are like umpires. Umpires don’t make the rules. They apply them…Nobody ever went to a ballgame to see the umpire.”

 

Yet, justices do make rules not only in new precedent, but in the operation of the court system. Those rules are being broken.

 

In the same week as the new leak, Justice Sonia Sotomayor attacked her colleague Brett Kavanaugh as essentially an out-of-touch prig who had never even met an hourly wage worker. It was an unfair insult and a departure from the Court’s long-standing rules of civility. (Sotomayor later apologized).

 

Additionally, a forthcoming book by Mollie Hemingway on Justice Samuel Alito contains an embarrassing account of how Justice Elena Kagan allegedly screamed at Justice Stephen Breyer so loudly before the Dobbs opinion that the “wall was shaking.” (The book suggests that Kagan was upset with Breyer agreeing to spur along the dissents to get out the final opinions in light of rising threats against conservative colleagues after the leak).

 

For an institution that prides itself on its confidentiality and insularity, the Court is looking increasingly porous and partisan in these leaks. Worse yet, people are indeed coming to the Court “to see the umpires.”

 

The most recent leak was published by the New York Times, which was given internal memos from various Supreme Court justices on the use of what is known as the “shadow docket” to issue rulings without oral arguments.

 

Notably, the leaks occurred after a controversial speech by Justice Ketanji Brown Jackson at Yale Law School in which she denounced the use of the shadow docket by her conservative colleagues to release decisions that were sometimes “utterly irrational.”

 

The memos reveal the concern of the justices that the Environmental Protection Agency was effectively gaming the system, imposing unlawful regulatory burdens on electric utilities despite a countervailing earlier ruling in Michigan v. EPA.

 

Chief Justice Roberts noted that the EPA was using the ongoing litigation to force utilities to spend billions of dollars to comply with the new regulations: “In other words the absence of stay allowed the agency to effectively implement an important program we held to be contrary to law.”

 

The controversy over the use of the shadow docket is immaterial to this story. The most immediate concern for Roberts should be that this is strike two: another leak from within the Court that was clearly designed to wound some of its members.

 

Unlike the Dobbs leak (which appeared to be an effort to influence the final opinion), this is a leak about a decade-old case. It had a purely malicious purpose to embarrass or disrupt the Court.

 

The question, again, is the identity of the culprit. There is no reason to assume that the same person was involved in both leaks. Rather, the leaks appear to reflect a deteriorating culture at the Court.

Kuwait Declares Force Majeure As US Seizure Of Iranian Ship Escalates Tensions

 

Kuwait has declared force majeure on shipments of crude oil and refined products after disruptions at the Strait of Hormuz prevented some vessels from entering the Persian Gulf.

 

The move comes as tensions in the Strait escalated again following the U.S. seizure of an Iranian-flagged cargo vessel in the waterway.

 

According to Reuters, Kuwait Petroleum Corporation has notified customers that it is invoking contractual clauses allowing it to withhold certain scheduled deliveries after the blockade hindered access to the Gulf. The measure is not expected to result in a complete halt to supply.

 

The latest escalation follows a volatile weekend in which the Strait briefly reopened before closing again after Iran linked the reopening of the shipping lane to the lifting of the U.S. naval blockade targeting its oil exports.

 

Iran’s foreign ministry said it has no plans for a new round of talks following the U.S. seizure of the vessel. U.S. President Donald Trump said a delegation led by Vice President JD Vance is heading to Islamabad for talks. Pakistan has tightened security in the capital ahead of the potential negotiations.

 

Iran has warned that it cannot guarantee safe passage through the Strait of Hormuz if its oil exports continue to be restricted, saying that security for shipping in the waterway cannot be separated from pressure on its own crude flows.

 

Shipping activity in and around the Strait has been disrupted again, with vessels altering routes and operators reassessing transit risks through one of the world’s most important oil shipping lanes.

 

After plunging late last week, oil prices rebounded in early trading as markets reacted to the renewed disruption and the risk of further constraints on flows through the Strait of Hormuz.

 

The renewed pressure also comes as Iran-aligned Houthis have threatened to target the Bab el-Mandeb Strait, raising concerns about additional risks to alternative export routes for Middle East crude.

DOJ Shakeup In Florida Signals Major Escalation In Russiagate Criminal Probe

 

The Department of Justice appears to be gaining fresh momentum in its criminal investigation into the 2016 Trump-Russia collusion narrative, with a significant overhaul of the team handling the case in southern Florida.

 

According to investigative journalist Julie Kelly’s reporting at Declassified.live, longtime Trump legal advisor Joe diGenova - a former U.S. Attorney and prominent commentator - will be sworn in Monday as counsel to the attorney general. He will assume leadership of the ongoing grand jury probe based in Fort Pierce, the district overseen by U.S. District Judge Aileen Cannon. That same courthouse was the site of Cannon’s landmark July 2024 ruling dismissing Special Counsel Jack Smith’s classified documents case against President Trump after she found Smith’s appointment unconstitutional. The grand jury has been active in Fort Pierce since January, Kelly reports.

 

DiGenova’s wife, Victoria Toensing, has also served as a key Trump legal counselor for years. In a notable earlier move, the Biden Justice Department seized Toensing’s cellphone in April 2021 during a separate inquiry tied to Rudy Giuliani’s efforts to examine the Biden family’s overseas dealings.

Earlier this week, acting Attorney General Todd Blanche removed the career prosecutor previously in charge of the investigation into former CIA Director John Brennan, who played a key role in concocting the Trump-Russia collusion scheme in 2016. Spanish Catholic Church plagued by pedophiles – media

 

More than 3,000 victims of sexual abuse and over 1,600 suspects have been identified in an eight-year-long probe by El Pais

 

More than 3,000 people have reportedly suffered sexual abuse as minors within the Spanish Catholic Church, according to a eight-year investigation by the El Pais newspaper which published its latest findings on Monday.

 

The outlet began collecting data on sex crimes within the church in 2018, when only 34 cases were officially known. Since then, through public testimonies, judicial records, and church admissions, the number of victims of pedophilia has risen to 3,084 with the earliest incidents dating back to the 1940’s.

 

The list of accused has reached 1,613, representing 1.46% of the 110,000 priests and laypeople who have served in Spain in the past 80 years.

 

El Pais’ latest report, the sixth in five years, has added 58 new testimonies from Spain accusing 50 clerics and laypeople, all men except two nuns, and a separate section covering 21 testimonies from eight Latin American countries with 24 individuals accused.

 

The outlet said that it has shared all its findings with the Spanish Episcopal Conference (CEE), the Vatican, and Spain’s human rights commissioner. However, the newspaper noted that over the past five years, the Church has not responded substantively to the allegations with the CEE prioritizing “opacity and denial” while the Vatican has delegated responsibility to the Spanish bishops.

 

El Pais has also noted a recurring pattern where accused priests are often transferred between parishes or sent abroad, sometimes to Latin America, without facing canonical or civil consequences. In several cases, religious orders are accused of having moved known offenders to new locations where they continued to have access to children.

 

Previously, a 2023 survey by Spain’s human rights commissioner estimated that 1.13% of the adult population, about 440,000 people, may have suffered sexual abuse in a Catholic environment.

 

The latest findings mirror similar revelations in the US, where the Diocese of Brooklyn is currently seeking a global settlement for 1,100 child sex abuse cases, having already paid over $100 million to survivors.

 

Pope Leo XIV, who will visit Spain in June, is said to have received copies of El Pais’s reports but the Vatican has yet to comment on the latest findings.

The Irish government is aiming to terminate government-provided accommodation for Ukrainian migrants within a year, while offering “generous” payouts to encourage their repatriation, Minister of State for Migration Colm Brophy has said.

 

Since the escalation of the Ukraine conflict in 2022, around 125,000 Ukrainians have received temporary protection in Ireland, according to Brophy. Between July 2022 and March 2026, Dublin reportedly spent more than €438 million ($516 million) to provide half of them with housing.

 

Dublin has also shelled out nearly €400 million in “political, humanitarian, economic and non-lethal military aid” for Kiev, while other EU members have funneled billions upon billions of euros into the conflict. Moscow has repeatedly said that the bloc’s support for Kiev has only served to prolong the hostilities.

 

In an interview with the Times published on Saturday, Brophy said that discussions were underway within the Irish government with a view to axing state-provided accommodation over the next 12 months.

 

“I don’t see why we as taxpayers should be paying out millions and millions and millions… because no other EU state is providing that,” the minister stated, adding that the “timeline is the critical thing here.” The termination of the program has yet to be finalized at the government level, though, he clarified.

 

According to Brophy, the Irish government was also considering offering “generous” financial incentives to encourage Ukrainians to return home.

 

According to Eurostat, an estimated 4.35 million Ukrainians are registered for temporary protection across the EU. In recent months, a number of member states, including Poland, Germany, Denmark, the Czech Republic, and Hungary, have moved to curb social programs for Ukrainian migrants.

 

German Chancellor Friedrich Merz announced last week that Berlin and Kiev would coordinate efforts to return military-age Ukrainian men residing in Germany to their home country.

Israel claims ownership of Lebanese gas field after establishing Gaza-style ‘Yellow Line’ near border

 

Tel Aviv has openly vowed to destroy all Lebanese border villages and prevent their residents from returning

 

Israel has declared a large swath of the southern Lebanese border area a “Forward Defense Zone,” similar to the ‘Yellow Line’ perimeter used by Tel Aviv to seize additional territory in the Gaza Strip.

 

The Israeli military’s Arabic spokesman Avichay Adraee, on 19 April, published a map of the area, where he said troops are operating to destroy “Hezbollah-affiliated infrastructure.”

 

The map covers areas beyond the southern Lebanese coast and into the ocean, including the Qana gas field, which belongs to Lebanon according to the maritime border agreement reached indirectly between Beirut and Tel Aviv in 2022.

 

“Five military brigades are operating alongside Navy forces simultaneously south of the forward defense line in southern Lebanon to destroy Hezbollah-affiliated infrastructure in the area and prevent a direct threat to the northern towns,” Adraee said.

 

The Israeli military initially referred to the 10-kilometer area as a ‘Yellow Line.’

 

According to the Israeli army, the 10-kilometer zone includes 55 towns and villages in southern Lebanon.

 

However, Lebanese researcher Ahmad Baydoun revealed that the area “covers approximately 70 Lebanese villages – more than the 55 villages reported by Israeli media,” adding that the zone includes towns “known to still be inhabited: the Christian villages of Rmeish, Debl, and Ain Ebel, and the Sunni town of Shebaa.”

President of Argentina Javier Milei and Israeli Prime Minister Benjamin Netanyahu on Sunday launched the “Isaac Accords,” a new strategic framework aimed at strengthening cooperation between Argentina, Israel and like-minded partners in the Western Hemisphere.

 

In an official statement, the Argentine Foreign Ministry detailed that the Isaac Accords constitute a new strategic framework between Argentina, Israel, and “the descendants of Isaac and nations with a Judeo-Christian tradition” in the Western Hemisphere that is designed to strengthen cooperation in the defense of freedom and democracy, and promote the joint fight against terrorism, antisemitism, and drug trafficking.

 

The Isaac Accords, the Ministry pointed out, were conceived by Milei and are inspired by the vision of President Donald Trump’s Abraham Accords, noting that the Accords will have a particular focus on countering Iran’s attempts to expand its terrorist networks and operational presence in the Western Hemisphere. The initiative also aims to “foster coordination and alignment in international forums, as well as to promote a framework for expanding cooperation in innovation, technology, trade, and economic openness.”

 

“The Isaac Agreements aim to promote peace through actions that foster long-term regional stability, security, and economic prosperity,” the Argentine Ministry said. “We welcome the expansion of the Agreements to include other like-minded nations in the Western Hemisphere that share these values.”
