Retired Lawyer Sues to Block Trump Coin, Citing 160-Year-Old Federal Law

A retired Oregon lawyer has filed a federal lawsuit seeking to block the US Mint from producing a commemorative gold coin bearing President Donald Trump’s likeness, arguing that a statute barring living figures from US currency — on the books since 1866 — makes the plan flatly illegal.

 

James Rickher, a former federal employee and coin collector, filed the pro se complaint at the US District Court in Oregon on March 24, naming Treasury Secretary Scott Bessent and acting US Mint design chief Megan Sullivan as defendants.

 

The legal basis is Title 31 US Code Section 5114, a provision Congress first enacted in 1866 that restricts currency portraits exclusively to deceased individuals. Rickher says there is no room for interpretation. “It’s black and white. It’s very straightforward. It’s very clear that it’s prohibited,” he said.

 

Trump personally selected the design after Treasury Secretary Bessent presented options, according to the lawsuit. The final image — a 24-karat gold coin using an official White House photograph — cleared the US Commission of Fine Arts on March 20 by unanimous vote. Trump had previously dismissed the commission’s former members and replaced them entirely with his own appointees. The administration has positioned the coin as a tribute to the nation’s 250th anniversary, set for July 4, 2026.

 

Federal officials contend a subsection of the law grants the Treasury Secretary discretionary authority over coin designs, including commemorative issues. Rickher disputes that reading. “He can’t override the statute. There’s no exemption within his discretion to allow that to happen,” he said.

 

The administration may further contend the coin is exempt because it functions as a collectible — a limited-edition gold piece priced above face value and never meant to enter everyday circulation. Rickher’s lawsuit rejected that argument, calling it inconsistent with the plain language of the statute.

Save America Act will be delayed which may cause it to be passed too late to be used without complaint that it is too close to the mid term elections. And, didn't POTUS say that he would not sign ANY bill that came before him until the Save America Act was signed.

Senate Majority Leader John Thune has no intention of abandoning the Safeguard American Voter Eligibility (SAVE) America Act, a source familiar with the bill process told The Federalist.

 

On Monday afternoon, Rep. Anna Paulina Luna, R-Fla., posted on her X account that Thune is washing his hands of the critical election integrity reform bill supported by the vast majority of Americans.

 

“Just so America knows, after two weeks in recess, John Thune is no longer considering the SAVE America Act,” Luna wrote.

 

The congressional source with knowledge of the situation told The Federalist on Monday evening that Luna’s comment “is not true.” He said the bill, which requires documentary proof of U.S. citizenship to register to vote and photo identification at the polls, is “still the pending business in the Senate.”

 

“We will be considering ICE and Border Patrol funding followed by FISA, all priorities of the president,” the congressional insider wrote in an email to The Federalist. “The senate can always return to SAVE after considering those items. We started debating it five weeks ago.”

 

Luna’s assertion seemed to have some supporting evidence.

 

An X post Monday by Punchbowl News’ Andrew Desiderio raised concerns that the SAVE America Act was doomed. Desiderio reported the Senate “is off the bill this week and may not return to it any time soon, if at all.” Thune reportedly told Punchbowl’s Laura Weiss that the Senate has “other pressing stuff” to take care of.

 

“If we don’t have other pressing stuff in front of us that has to get done … then we’ll see about getting that going,” Thune said, according to the reporter’s X post.

It won't matter what other bills Thune passes, POTUS won't sign them until the Save America Act is passed and on his desk. Thune may consider them more "pressing issues", but POTUS does not.

President Donald Trump said he would stop signing bills until Congress passes the Safeguard American Voter Eligibility, or SAVE America, Act, a bill that would require individuals to provide proof of citizenship upon registering to vote, as it attempts to get through the Senate.

 

Trump made his latest move in support of the bill on March 8, writing on Truth Social that he would not sign any other bills that pass his desk until the SAVE America Act is through Congress.
