When someone intentionally incites a violent riot, a resulting death is generally considered reasonably foreseeable under U.S. criminal law. Courts treat violent outcomes as predictable when a person urges or organizes conduct that is likely to erupt into immediate violence.

Federal conspiracy law including RICO often applies the Pinkerton doctrine, which holds coโ€‘conspirators liable for crimes committed by others if:

The crime was in furtherance of the conspiracy, and

It was reasonably foreseeable.

This means that if the enterprise is violent, a killing may be considered foreseeable. If the murder is charged under VICAR (Violent Crimes in Aid of Racketeering) courts have upheld murderโ€‘related convictions tied to racketeering when the killing is part of the enterpriseโ€™s activities.
