This is the problem right here, we are arguing over emergency powers when in fact it is a plenary power of the POTUS without Congressional nor Judicial approval.

I cannot believe we lost this, who are the lawyers? Did they even argue this? The POTUS has this inherent power, regardless of emergency or not.
