Justice Department Notifies Fairfax County, Virginia Commonwealth’s Attorney of Investigation into His Plea Bargaining, Charging Decisions, and Sentencing Policy
Today, the Justice Department notified the Fairfax County, Virginia Commonwealth’s Attorney Steve Descano of the initiation of a federal investigation into the Commonwealth’s Attorney Plea Bargaining, Charging Decisions, and Sentencing Policy. The Justice Department’s Civil Rights Division will investigate whether the Office of the Fairfax Commonwealth’s Attorney discriminated against United States citizens by offering preferential treatment only to illegal alien criminal defendants.
“Under my leadership, the Civil Rights Division will not allow local prosecutors to pick and choose winners based on their immigration status,” said Assistant Attorney General Harmeet K. Dhillon of the Justice Department’s Civil Rights Division. “This investigation will uncover whether this prosecutor is putting the community at risk in offering sweetheart deals to illegal immigrants charged with serious crimes.”
The Department has not reached any conclusions regarding allegations in these matters. The Department will investigate under various statutes, including Title VI of the Civil Rights Act of 1964, the Safe Streets Act, and law enforcement misconduct statute 34 U.S.C. § 12601. The Department has conducted similar investigations where violations have been found, and the resulting settlement agreements have led to important reforms.

Women’s tennis legend speaks out on California trans athlete controversy as Newsom faces criticism
Women’s tennis legend Martina Navratilova weighed in on the sudden trans athlete controversy in Gavin Newsom’s California, with the girls’ high school track and field championships coming up.
A trans athlete is set to compete in the girls’ tournament this year, after winning multiple state finals last year. California is continuing to let biological males compete in girls’ sports under Newsom’s leadership, prompting criticism from many activists.
Navratilova cheered on two gold-medal-winning women’s Olympians who spoke out against Newsom on Friday.
The tennis legend shared a Fox News Digital article of women’s Olympic gold medalists Nancy Hogshead and Kaillie Humphries addressing the track and field controversy.
“Newsom could overturn this in a second. No excuse,” Navratilova wrote.
“Cheating… which at the moment the rules allow. Thanks for nothing [Gavin Newsom],” Navratilova wrote.
Navratilova, like Hogshead, is a vocal advocate for protecting women’s sports despite supporting Democrats on other issues.
“Governor Newsom seems to exclude girls from his own standard of ‘fairness, dignity and respect.’ It is impossible to include a male — however they identify — into girl’s sports and have a fair competition, respecting and dignifying the unique biology of females. Females aren’t weakened males; males and females are built from different molds, so different that it justifies formal, government-sanctioned sex segregation,” Hogshead told Fox News Digital.
Hogshead, who represented the U.S. at the 1984 Summer Olympics, where she won three gold medals and one silver medal in swimming, has become a prominent activist in the fight to save women’s sports, despite being a lifelong Democrat. Hogshead is also a civil rights lawyer.
“The government never segregates racially and religiously, but we do segregate by sex because of biology, material reality. Girls and women rely on that formal sex segregation to have the possibility of equality in sport. Governor Newsom needs to include the girls competing in track in his own analysis. As a law professor, this is a big fail,” she continued.
Humphries, who is a tax-paying California citizen and rising Trump ally in the effort to protect women’s sports, criticized Newsom as well. Humphries has won three Olympic gold medals in bobsled for the U.S. and Canada and six medals in total, making her the most decorated women’s bobsledder in history.
“There is nothing fair about allowing boys to take opportunities from girls in sports. It’s just the left’s thinly veiled misogyny. Governor Newsom should be focusing on California hosting the Olympics which actually knows the difference between men and women and quit pushing his woke agenda which is out of the mainstream of the American public,” Humphries told Fox News Digital.
The source within Newsom’s office responded to news that a “Save Girls Sports” protest will be held on Saturday at the site of a track and field playoff meet.
“The Governor has said discussions on this issue should be guided by fairness, dignity, and respect. He rejects the right wing’s cynical attempt to weaponize this debate as an excuse to vilify individual kids. The Governor’s position is simple: stand with all kids and stand up to bullies,” a source within the governor’s office told Fox News Digital on Wednesday.
“California is one of 22 states that have laws requiring students be permitted to participate in sex-segregated school sports consistent with their gender identity. California passed this law in 2013 (AB 1266) and it was signed into law by Governor Jerry Brown.”
After Jurupa’s trans athlete won first place in triple jump and high jump, and second place in long jump, President Donald Trump’s Department of Justice launched a lawsuit against California state agencies for alleged Title IX violations last July.
Trump’s administration cracked down with a more targeted investigation of JUSD in January. The U.S. Department of Education announced JUSD specifically would be investigated for potential Title IX violations, along with 17 other institutions.

Trans athlete dominates California girls’ track meet as protesters demand: ‘Keep men out of women’s sports’
A trans competitor at a California girls’ track meet swept the field in multiple events Saturday while protesters outside demanded biological males be barred from competing against girls.
At the CIF Southern Section Division 3 preliminaries held at Yorba Linda High School, AB Hernandez, a senior from Jurupa Valley, delivered commanding performances in all three jumping events against female athletes.
The biggest gap came in the triple jump, where Hernandez posted 42 feet, 4 inches. The nearest competitors finished at 39 feet, 7 1/2 inches and 37 feet, 8 inches.
In the long jump, Hernandez recorded 20 feet, 4 1/4 inches, finishing more than a foot ahead of the second-place mark of 19 feet, 1 1/2 inches. Third place reached 18 feet, 7 inches.
Hernandez also tied for first in the high jump after clearing 5 feet, 2 inches alongside Reese Hogan.
The results immediately reignited outrage from critics who argue biological males possess physical advantages that undermine fairness in girls’ athletics.
Outside the venue, demonstrators gathered before the meet for a “Save Girls’ Sports” rally led by former NCAA athlete Sophia Lorey.
One protester angrily accused California Gov. Gavin Newsom of abandoning female athletes, shouting that “girls are being threatened.”
For many in attendance, the outcome felt familiar.
“It happened last year and I thought it’d be done, but it’s California,” one grandparent attending to support Moorpark High School told Outkick.
Hernandez has already become a central figure in the escalating national fight over transgender participation in girls’ sports.
The athlete previously competed in girls’ volleyball and has repeatedly drawn scrutiny after winning girls’ track events.
Saturday’s meet marked another high-profile showdown with Hogan, who previously made headlines after stepping onto the top podium spot following an event won by Hernandez, a gesture applauded by advocates pushing to reserve women’s sports for biological females.
The controversy surrounding California’s policies has moved far beyond high school athletics.
The US Department of Justice is suing California over its transgender athlete rules, while the US Department of Education has expanded investigations into multiple California schools and athletic organizations over potential Title IX violations tied to trans athletes competing in women’s sports.
That federal investigation now includes the California Community College Athletic Association, which oversees 108 athletic programs statewide.
“Women’s sports are for women,” Assistant Secretary for Civil Rights Kimberly Richey said. “The Trump administration will not tolerate policies that erase women’s rights.”
Tennis icon Martina Navratilova backed Olympic gold medalists Nancy Hogshead and Kaillie Humphries after they criticized California’s handling of the issue.

North Carolina Medicaid billing for ‘autism therapy’ jumps from $1 million to $660 million
As fraud concerns ramp up across the country, particularly involving Medicaid, North Carolina State Auditor Dave Boliek told Fox News Digital the problem is very real in his state, especially when it comes to autism therapy, an area that has been highly scrutinized in Minnesota.
Boliek is sounding the alarm on potential waste, fraud and abuse within the state’s Medicaid program, specifically noting in an interview with Fox News Digital a 47,000% explosion in autism therapy billings he has flagged since taking office last year.
"Those are vital services to folks and individuals that need that therapy," Boliek said. "But when you have, like in North Carolina, a system that went from $1.4 million or so in total billings for autism therapy to more than $660 million a year in billings on autism therapy within a five-year range, that begs an audit from the state auditor, who in North Carolina, we are the top watchdog agency for taxpayer waste, fraud and abuse prevention. So, we've dug down into that and are in the middle of that."
Boliek, who was speaking to Fox News Digital at the annual State Financial Officers Foundation conference in Orlando, says his office is "hand in hand" with Vice President JD Vance’s focus on eliminating waste, fraud and abuse to "make sure that the people who need the services and deserve those services get the services" without "wasting money."
"What we’ve got is we’ve seen examples where there might be three different clinical providers billing during the same tranche of time on an autism therapy client, and that is because of poor rulemaking," Boliek explained. "Some of it is possibly illegal and probably illegal, and we’re going to point that out, and we’re going to try to put people in cuffs because of it.
"But some of it might be technically legal because of the lax oversight from a Democrat-led Department of Health and Human Services," Boliek said, referencing the top state health agency in North Carolina.
In a March 10, 2026, hearing of the Joint Legislative Oversight Committee on Medicaid, the North Carolina Department of Health and Human Services presented data that matches Boliek's narrative of exponential growth in autism therapy.
The report confirmed that Medicaid spending on ABA (applied behavior analysis) therapy grew by 347% between 2022 and 2025 alone and that total spending is projected to hit $842 million in state fiscal year 2026 and $1.14 billion by state fiscal year 2027.
Medicaid fraud has been a hot-button issue across the United States after a scandal in Minnesota gained widespread attention last fall and spreading to places like California and Ohio, the latter being the subject of a recent Daily Wire exposé examining seven medical buildings in Columbus, Ohio, that house 288 Medicaid companies and bill the government $250 million.
The key issues with Medicaid and the ease with which it can be abused both illegally and legally, according to Boliek, are the "minutiae of rulemaking" that is "built in by government."
"For example, how individual entities, whether they are a provider of clinical medical services or whether they're a provider of daycare services or other services that can be paid for through departments of Health and Human Services, how those rules are set up and what the billing rules are," Boliek explained.
During the developing fraud scandal in Minnesota, federal agents discovered that one suspected scammer defrauded the state’s autism treatment program of roughly $14 million and allegedly billed Medicaid for fake therapy sessions, used untrained staff and paid parents $300 to $1,500 a month to keep their kids in the program.
The state’s autism program’s budget jumped from $3 million in 2018 to nearly $400 million in 2023, according to Dr. Mehmet Oz, the administrator of the federal Centers for Medicare and Medicaid Services.
"The fraud is so obvious, just simply looking at the exponential growth in some of these social services programs, that anybody kind of looking at how fast this was growing should have known that a fraud was a major reason why," Minnesota state Sen. Michael Kreun, a Republican, told Fox News Digital in December about social services fraud in his state.
In terms of next steps in North Carolina, Boliek says his office is working with lawmakers to strengthen fraud enforcement by increasing financial accountability, expanding investigative and Medicaid audit resources and investing in staff and technology to recover misused funds.
The State Financial Officers Foundation, a group of financial officers that collectively oversees more than $3 trillion in state funds, released a report earlier this year outlining how the organization safeguarded more than $28 billion of waste, fraud, and abuse in 2025 alone.
