The agency greenlit 4 Glas electronic nicotine delivery systems through the premarket tobacco product application pathway, a historic first that comes amid reported White House pressure on FDA Commissioner Marty Makary.

 

The FDA has authorized the marketing of 4 Glas electronic nicotine delivery systems (ENDS) through the premarket tobacco product application (PMTA) pathway, the agency announced on May 5, 2026, marking the first time it has authorized nontobacco, nonmenthol flavored vaping products for sale in the US.1,2

 

The authorized products are e-liquid pods, each containing 50 mg/mL (5%) of tobacco-derived nicotine, marketed under the names Classic Menthol, Fresh Menthol, Gold, and Sapphire. Gold and Sapphire correspond to mango and blueberry flavors, respectively, according to the FDA release.1,2

 

The authorization came the same day The Wall Street Journal reported that President Donald J. Trump rebuked FDA Commissioner Marty Makary, MD, MPH, for not moving quickly enough to approve flavored vapes and nicotine products. Earlier this year, The Wall Street Journal reported that Makary was opposing the authorization of the 4 Glas products after FDA scientific advisers had authorized them. Now, the company has been authorized to legally market its products to users 21 years or older.3,4

U.S. Admits Losing Over 40 Aircraft In War On Iran

 

A Congressional report released on May 19 revealed that the United States military lost at least 42 aircraft during 40 days of war on Iran.

 

The report, prepared for Congress using information from the Pentagon, United States Central Command, and defense media outlets, estimated the total cost of the aircraft losses at approximately $2.6 billion. The aerial losses include fighter jets, surveillance aircraft, refueling planes, combat rescue helicopters, and drones.

 

Among the aircraft destroyed or damaged, according to the document, were four F-15E Strike Eagle fighter jets, one F-35A Lightning II stealth fighter jet, one A-10 Thunderbolt II attack jet, seven KC-135 Stratotanker refueling planes, and one E-3 Sentry airborne warning and control aircraft.

 

The report also listed the loss of two MC-130J Commando II special operations transport planes, one HH-60W Jolly Green II special operations helicopter, 24 MQ-9 Reaper combat drones, and one MQ-4C Triton high altitude surveillance naval drone.

 

Replacing some of the destroyed aircraft could require restarting production lines for systems that are no longer manufactured, the document said.

 

It also noted that the destruction of an E-3 Sentry could force the Pentagon to revive the cancelled E-7 Wedgetail replacement program at a cost exceeding $2.5 billion.

 

Analysts cited in the document estimated that total aircraft losses and replacement programs could eventually exceed $7 billion.

 

The number confirmed by the Congressional report is still short of the 56 U.S. military aircraft documented in Wikipedia’s list of aviation shootdowns and accidents during the Iran war, which only counts losses based on visual evidence or official self-admission.

 

Commenting on the report, Iranian Foreign Minister Abbas Araghchi said that the document confirmed the Islamic Republic’s ability to inflict serious damage on the U.S. military.

 

“Months after initiation of war on Iran, US Congress acknowledges loss of dozens of aircraft worth billions,” Araghchi wrote on X.

 

“Our powerful Armed Forces are confirmed as first to strike down a touted F-35,” he added, warning that any future conflict would feature “many more surprises.”

 

Of course, the Congressional report shed light on only one side of U.S. military losses during the war on Iran. In addition to aerial losses, billions worth of air defense, radar and communication systems throughout the Middle East were destroyed or damaged by Iranian missile and drone strikes.

 

The total cost of the 40 days of war on the Islamic Republic is reported to be around $25 billion. With peace deal reached yet, this may not be the final cost.

Former DOJ Attorney Indicted for Concealment, Theft of Government Records

 

Fort Pierce, Florida – Carmen Mercedes Lineberger, 62, of Port St. Lucie, has been indicted in federal court for two counts of theft of government money or property, valued less than $1,000.00; destruction, alteration, or falsification of records in federal investigations; and concealment, removal, or mutilation of public records. John P. Heekin, United States Attorney for the Northern District of Florida announced the charges.

 

The indictment alleges at the time of the offenses the defendant served as the Managing Assistant United States Attorney (MAUSA) of the Fort Pierce branch of the United States Attorney’s Office for the Southern District of Florida. In separate instances in late-2025, the defendant altered the electronic file names of government records that she received in her official capacity as the MAUSA in order to conceal her unauthorized electronic transmission of those records to personal email accounts belonging to her without being detected. The altered government records included a document compiled by the defendant consisting of portions of internal DOJ electronic messages and an internal DOJ memorandum, and a DOJ report related to a criminal prosecution in the SDFL that had been court-ordered to remain under seal and prohibited from distribution or disclosure outside of DOJ.

 

As alleged in the indictment, the defendant concealed her actions by saving electronic copies of the government records in question under the misleading files names “chocolate cake recipe” and “bundt cake recipe” before electronically transmitting those records to her personal email accounts. As to the DOJ report, the indictment further alleges the defendant acted knowing that her transmission of the record outside DOJ directly violated the court order and impaired the proper administration of the underlying criminal prosecution.

 

Lineberger appeared in federal court today for her arraignment before Southern District of Florida Chief United States Magistrate Judge William Matthewman in West Palm Beach, Florida.

 

If convicted, Lineberger faces up to twenty years’ imprisonment for destruction, alteration, or falsification of records in federal investigations, three years’ imprisonment for concealment, removal, or mutilation of public records, and up to one year imprisonment on each count of theft of government property valued at less than $1,000.

 

The case is being jointly investigated by the Federal Bureau of Investigation and the Department of Justice, Office of the Inspector General. The case is being prosecuted by Assistant United States Attorney Christie S. Utt from the Northern District of Florida, who was assigned as a special prosecutor to avoid conflicts of interest with the investigation and prosecution of this matter.

 

An indictment is merely an allegation by a grand jury that a defendant has committed a violation of federal criminal law and is not evidence of guilt. All defendants are presumed innocent and entitled to a fair trial, during which it will be the government’s burden to prove guilt beyond a reasonable doubt at trial.
