The Executive branch is too easily thwarted by partisan judges. This is a major flaw in the system. Consider that many of these judges could be rogue agents of foreign governments or global interests who worked their way to become judges through the lax immigration system and affirmative action. Consider that the Left has planned this for years and has purposefully and methodically stacked the courts with crypto-commies.
