By a vote of 6-3, the justices struck down a federal law that bars the president from firing members of the Federal Trade Commission except in cases of “inefficiency, neglect of duty, or malfeasance in office.” [PDF Ruling Here] That law, a majority of the justices ruled, violates the constitutional separation of powers between the three branches of government.

At issue in Trump v Cook is not whether Lisa Cook can appeal her removal, but rather where her position rests while the appeal is underway. Does she work for the govt? Or is she technically removed from govt, pending appeal?

 

The Supreme Court ruled in favor of Lisa Cook remaining in her position as a member of the Federal Reserve’s Board of Governors whom President Donald Trump had attempted to fire. By a vote of 5-4 [PDF HERE] [the court says Cook can continue to remain in her job while her challenge to Trump’s removal moves forward.

 

Chief Justice John Roberts delivered the opinion of the Court, and SOTOMAYOR, KAGAN, KAVANAUGH and JACKSON concurred.

 

Justice Clarence Thomas filed a dissenting opinion. ALITO filed a dissenting opinion, in which GORSUCH joined, and BARRETT also filed a dissenting opinion.

 

This is a rather goofball decision when you consider the previous issues with the Consumer Financial Protection Bureau and the high court prior ruling that President Trump can remove the head of the agency.

 

Additionally, if Lisa Cook does not work for the President of the United States, meaning if she doesn’t work for the Executive Branch, then who exactly is she working for? She doesn’t work for the legislative branch, and she doesn’t work for the judicial branch. Therefore, a de facto mysterious 4th branch of government is created.

 

Writing the majority opinion, Chief Justice John Roberts said if the Trump administration were correct, it “would in effect transform the Federal Reserve’s for-cause protection into at-will employment, an leap out of step with the statute Congress enacted and our Nation’s tradition of central banking protected from political interference.”

 

Justice Clarence Thomas said the 5-4 ruling was “incorrect.” “Although the Court expresses concern that the President removed a Board member for ‘the first time in the Federal Reserve’s 111-year history, it expresses no such concern that it today upholds an injunction [here] against the President’s removal of an executive officer for the first time in the Constitution’s 237-year history.”

 

If the Federal Reserve Board of Governors are not subject to the plenary power of the executive branch, then who controls it? If no one, then the Federal Reserve Board (FED) exists to control the American economy without any oversight from any mechanism within the U.S. Constitution.

 

The federal reserve is a fourth branch of government?

 

This decision seems rather weird….. Especially when the next ruling is considered.

Justices Overturn 1935 Precedent, Backing President’s Power to Remove Agency Heads

The Supreme Court on Monday handed President Trump a sweeping victory over the administrative state, ruling that Congress cannot shield the heads of independent regulatory agencies from presidential removal, and overturning a landmark 1935 precedent that had underpinned the modern regulatory framework for nearly a century.

 

The 6-3 decision in Trump v. Slaughterarose from the President’s firing of two Democratic-appointed Federal Trade Commission commissioners, Rebecca Slaughter and Alvaro Bedoya, at the start of his second term.Trump cited his constitutional authority under Article II rather than any cause recognized by the FTC’s governing statute, which permits removal only for “inefficiency, neglect of duty, or malfeasance in office.”

 

Writing for the majority, Chief Justice John Roberts concluded thatthe FTC’s for-cause removal protection is incompatible with the Constitution’s vesting of executive power in a single President. Officers who exercise executive power, the Court held, must remain accountable to the President — and accountability requires the ability to remove them at will.

 

The ruling explicitly overturned Humphrey’s Executor v. United States, which had carved out an exception to presidential removal authority for agencies exercising so-called quasi-legislative and quasi-judicial functions. The Court found that characterization had never made sense and had become increasingly untenable as the FTC’s powers expanded to cover virtually every corner of the American economy.

 

The decision’s reach extends well beyond the FTC, potentially exposing the leadership of dozens of independent agencies — including the SEC, CFTC, and NLRB — to at-will presidential removal.

 

One major institution stands apart. The Court indicatedthat the Federal Reserve may occupy a different constitutional category because of its unique historical lineagetracing to the First and Second Banks of the United States. In a companion decision released Monday, the Court rejected President Trump’s bid to stay a lower court order that allowed Fed Governor Lisa Cook to remain in place while litigation over her removal continues. The Court said the president failed to provide Cook with required notice and a fair opportunity to reply to allegations against her.The 5-4 majority opinion in that case said that “for cause” protection of Fed governors is consistent with the Constitution and the history of central bank independence in the U.S.== (what, that’s ridiculous the bank was never independent, they can’t be.)

Some attendees of the Great American State Fair in Washington, DC,said they have not seen partisan politics overshadow the event celebrating Americadespite the fact that criticsaccused President Trump of using the event to promote his administration and agenda.

 

The 16-day event, which kicked off last week, celebrates all 56 U.S. states and territories and features a giant Ferris wheel, flyovers, rodeos, and more ahead of America’s 250th birthday.Prior to the event, several celebrity artists who were slated to participate in the “Freedom 250” Great American State Fair concert series backed out, alleging that Freedom 250 — which is leading the events celebrating America —is too partisan and is tied to the Trump administration. Artists who backed out include Morris Day, Young MC, the Commodores, Bret Michaels, and Martina McBride. Some states have opted to forgo sending delegations to the event, also asserting it was too partisan.(they fucked themselves with their partisan opinion of it was going to be too partisan.)

 

But attendees of the event tell a different story. According to NBC News, “over a dozen attendees Saturday —on both sides of the political aisle — told NBC News that they didn’t feel the atmosphere at the fair had any kind of political tinteven as Trump has tried to redesign Washington in his image and as musical acts dropped out of the event.”

 

One attendee named Pamela said the event has “just been all about America,” noting that she has not witnessed anything political.

 

She added, “People are just being people [and] enjoying, you know, they’re being kind, opening the doors, holding them for each other, and it’s just kind of neat to see.”

 

The outlet spoked to another individual named Daniela who lives in the area and was expecting something like a “MAGA rally.”

 

“I think we heard a lot, like in our communities, that it was gonna be like a MAGA rally,” she said. “It, I think, has been very much nonpartisan.”

 

She added that the visitors she has witnessed simply want to celebrate America.

 

Another visitor, Nicole, described the fair’s atmosphere as “great.”

 

“It’s a once-in-a-lifetime event for our generation,” she said, adding, “I think it’s a great atmosphere. The vibe is great.”

 

President Donald Trump formally kicked off the state fair on Wednesday evening with a speech dedicated to celebrating America.

 

“Ten days from now, our country will celebrate one of the most monumental milestones in human history, marking 250 years of glorious American freedom,” Trump said.

 

“In 1776 our founding fathers met in Philadelphia and changed the world forever and ever with a thing called the Declaration of Independence,” he continued. “They proclaim the eternal truth that we are endowed by our Creator with the right to life, liberty, and the pursuit of happiness. We are all made, and you know that, free and equal by the hand of Almighty God.”

 

Each day of the state fair — which runs through Friday, July 10 — has unique themes, from “Land & Prosperity” to “Faith, Values, and Inspiration.”Monday’s theme, for example, is “Everyday Health and Well Being,” or “MAHA Monday.”

Sophie Cunningham Blasts WNBA, Accuses Player of ‘Targeting’ Caitlin Clark

“Unfortunately, this type of shit happens every single game to her, and the league and the refs do absolutely nothing about it,” the Fever star added.

 

Cunningham also made waves on Wednesday whenshe accusedly pointed at the useless refs and Mercury player DeWanna Bonner.

 

The player was heard joking on a podcast that her technical foul was“the weakest thing I’ve ever seen in my life”and added she“didn’t say a word” and “all I was doing was literally pointing.”

 

“I couldn’t help myself. I could not.She was losing her s— and all I was doing was literally pointing,” Cunningham explained.

 

Cunningham alsoripped the WNBA for leaving Clark off its commemorative league graphic(Cunningham herself is on that same poster).

She also said that the league is failing Clark and other Fever players.

 

“If they were smart, they would market the shit out of some of us. They don’t,” Cunningham exclaimed. “That should be Caitlin. That should be Kelsey Mitchell. That should be Aaliyah Boston. Like, why are we putting random players on there?”

 

“What we do makes no sense… Even the people they put on the commercials, like they could, if they’re really trying to make money, they are going to put people out there that first of all, people want to see, that people are going to bring attention to, and they just don’t. They just don’t. I don’t know what they think when all that happens,” she said.

 

After spending two years remaining mostly quiet about the abuse Clark is taking, Indiana Fevercoach Stephanie White finally spoke up last week about how Clark is being mistreated on the floor.

 

“The fist in the throat is crazy. It’s crazy. It’s dangerous,” White said. “… When you have these things continue to happen time and time and time again, eventually it gets frustrating, but I thought those were just more egregious.”

 

Alyssa Thomas was initially given no foul after slamming her fist into Clark’s throat.But the day after the game, the WNBA finally did move to punish the Mercury player.But, perhaps adding insult to injury,the league gave Thomas a tiny one-game suspension.

Officials: Man Kills Girlfriend, Dies of Heart Attack While Disposing of Her Body in Alabama Woods

 

A man killed his girlfriend and died of a heart attack while trying to dispose of her body in Chambers County, Alabama, officials said.

 

The deceased individuals were identified as 44-year-old Daniel Robbins of Georgia and 47-year-old Jessica Folds of Alabama, WKRC reported Sunday.

 

“Chambers County District Attorney Mike Segrest said Robbins was Folds’ boyfriend,” WTVM reported Thursday.

In a social media post on June 10, the Chambers County Sheriff’s Office saiddeputies were dispatched that afternoon to County Road 85 regarding a vehicle parked in the road. “Upon arrival, deputies located a deceased white female and white male in a wooded area near the vehicle,” the Sheriff’s Office reported:

 

When speaking of the deceased man and woman, Segrest said, “He died of a heart attack while doing it. Their bodies were right there together.”

 

“Based on the investigation, the female victim was strangled, and it appears the male was attempting to dispose of the body in a remote location,” he added.

 

According to WTVM:

Sheriff Jeff Nelson said the location where the bodies were found is believed to be a drop site, not the location where the murder occurred. A Ford truck was positioned in the road with the headlights still on and the driver’s side door open. Deputies found the woman with her hands raised over her head and the man next to her in a fetal position. A drag path was visible at the scene, Nelson said.

 

An autopsy confirmed that Folds had been strangled and that Robbins suffered a fatal heart attack at the scene, WTVM reported.

 

“The bodies were found next to each other in the brush beside the road,” and a man who reported finding the bodies of the “two unresponsive individuals” initially thought they were mannequins, WTVM reported.

Investigators said Robbins’ ex-wife explained he had preexisting heart problems.

 

“Special Agents with the Alabama Law Enforcement Agency’s State Bureau of Investigation launched a death investigation at the request of the Chambers County Sheriff’s Office. The Alabama Law Enforcement Agency is now leading the case, with assistance from the Chambers County Sheriff’s Office and FBI,” the WTVM article said.

 

Officials in the Alabama case said they believe the murder was the result of a domestic dispute, the New York Postreported, noting the bodies were found a few miles from the woman’s home.

 

Folds left behind three adult sons, and Robbins a daughter whose age is unknown.
