If the courts still refuse, then they are practicing Maritime law, which is British law created by a foreign entity. We practice Common law in the US, and there is no concept of a vessel being lost at see, only in Maritime law. Make the courts aware that if they rule against this, that they will be charged with treason under Military law. I am 100% sure, that you will win based upon this perspective of the actual law.
