Huge Win for Second Amendment — Federal Appeals Court Strikes Down New Jersey’s Unconstitutional Semi-Automatic Rifle Ban and Magazine Limit

The anti-gun agenda suffered a major legal defeat on Friday after the full U.S. Court of Appeals for the Third Circuit ruled that New Jersey’s ban on semi-automatic rifles and its prohibition on magazines holding more than 10 rounds violate the Second Amendment.

 

In a sweeping 10-5 en banc decision, the Third Circuit held that New Jersey’s so-called “assault firearm” ban cannot survive the constitutional test established by the U.S. Supreme Court in its landmark 2022 New York State Rifle & Pistol Association v. Bruen decision. The court also struck down the state’s 10-round magazine limit.

 

The 192-page opinion concluded that New Jersey’s prohibition on semi-automatic rifles, including the popular AR-15 platform, and its restrictions on so-called “large-capacity magazines” infringe on the constitutional right to keep and bear arms.

 

Writing for the majority, the court declared:

“Applying the framework announced in New York State Rifle & Pistol Association v. Bruen, 597 U.S. 1 (2022), we agree with the District Court that New Jersey’s ban on Colt AR-15s violates the Second Amendment. However, because the record supports the same result for all semi-automatic rifles—not only Colt AR-15s—we will MODIFY the District Court’s order so that it deems the Assault Firearm Provisions unconstitutional with respect to the full class of semi-automatic rifles.

 

We will AFFIRM that part of the order as modified. The LCM Provisions also violate the Second Amendment, so we will REVERSE the District Court’s order with respect to those. Because the LCM Provisions violate the Second Amendment, we need not address the Takings Clause challenge.”

 

As The Gateway Pundit previously reported, U.S. District Judge Peter Sheridan ruled in 2024 that New Jersey’s ban on the Colt AR-15 violated the Second Amendment, finding that the rifle is commonly owned by law-abiding Americans and protected under Heller and Bruen.

 

However, that earlier ruling left the state’s magazine restriction intact. Friday’s en banc decision goes significantly further by extending constitutional protection to the broader class of semi-automatic rifles while also striking down the magazine ban.

 

New Jersey’s Assault Firearm Provisions, originally passed in 1990 in the wake of a California shooting, criminalize the possession of a long list of semi-automatic rifles, pistols, and shotguns, plus anything “substantially identical.”

 

The state made it virtually impossible for law-abiding citizens to obtain a license, effectively creating a de facto ban. No civilian has ever successfully obtained such a license.

 

In 2018, Democrat lawmakers doubled down, lowering the “large capacity” magazine threshold from 15 rounds to 10 rounds, forcing residents to surrender, modify, or transfer standard magazines under threat of criminal penalties.

 

These laws were always about control, not safety.

NEW: DHS Shortens Duration of Visas for Foreign Reporters, Students, and Exchange Visitors

The Department of Homeland Security announced a new rule on Thursday, reducing the duration that foreign journalists, students, and cultural exchange visa-holders can stay in the country.

 

The new rule replaces the previously unspecified period of time that immigrants were admitted to the United States, known as “duration of status,” with a fixed number of days they will be allowed to stay.

 

“This decisive shift restores integrity to the nation’s immigration system, combats rampant visa abuse, and strengthens national security through regular vetting. A fixed period of admission is currently in place for many other types of nonimmigrant visas,” the Department of Homeland Security said.

 

With the exception of some Chinese nationals on I visas for representatives of foreign information media, journalists from other countries will be granted “admission for a fixed time period until they complete the activities or assignments consistent with the I classification, not to exceed 240 days.”

 

Chinese reporters face a much stricter 90-day limit.

 

According to the final rule’s public inspection version, “There were 37,330 admissions for I nonimmigrant foreign media representatives in the United States in FY 2024, over double the 16,753 admissions into the U.S. in 1985 and a nearly 15 percent increase from the prior fiscal year”

 

It also places restrictions on student F visas and cultural exchange J visas.

 

Exchange and student visas will only be granted for the duration of their programs, not to exceed four years.

 

The public inspection version of the rule reads,

In fiscal year (FY)2024 alone, there were over 1.8 million admissions in F status, a dramatic rise from when the legacy U.S. Immigration and Naturalization Service (INS) first shifted to D/S admission in 1979 and more than an 11 percent increase since FY 2023. For example, in the 1980-81 school year, there were approximately 260,000 admissions in F status. Similar growth in the J nonimmigrant population has also occurred over the past decades. In FY 2024, there were over 500,000 admissions in J status, up over 300 percent from the 141,213 J admissions into the United States in 1985 and up over 7 percent since FY 2023.

 

“The significant increase in the volume of F academic students, J exchange visitors, and I representatives of information media under D/S poses a challenge to DHS’s ability to monitor and oversee these nonimmigrants while they are in the United States,” it further states.

 

The amendment to the rule will take effect 60 days after publication in the Federal Register.

 

“For nearly half a century, the outdated ‘duration of status’ system has compromised national security and created an environment ripe for immigration fraud,” Homeland Security Secretary Markwayne Mullin said in a statement.

 

“For decades, foreign students have been admitted into the U.S. indefinitely, allowing thousands to abuse our immigration system by perpetually enrolling in courses to avoid having to leave the U.S. By implementing clear, finite limits on these visas, the United States is reclaiming its ability to properly screen, vet, and monitor individuals within our borders. This final rule ensures that foreign students remain focused on their primary purpose: completing their studies and returning home.”

WATCH: Viral Video Reveals Arabic Signage at Home Depot in Dearborn, Michigan

A video showing Arabic text added to department signs inside a Home Depot store in Dearborn, Michigan, is going viral on X.

The footage shows large hanging signs with standard English department names such as Appliances, Paint, Moving, Kitchen, Bath, Plumbing, and others, each with corresponding Arabic translations.

 

In the post, which had nearly a million views by Friday morning, Wall Street Apes wrote:

I found many major retailers in Dearborn have also added Arabic, locations at stores like Walmart, Home Depot, Costco, Kroger and Albertsons

 

Arabic shouldn’t be on any of our retailers signs. No foreign language should, but especially not Arabic. If we continue to let this happen we will only ensure we become the UK

 

Home Depot has reportedly added bilingual signs at multiple locations in Dearborn and nearby suburbs such as Livonia and Taylor.

 

Dearborn has experienced rapid demographic replacement in recent years.

 

U.S. Census Bureau data from 2020 shows that 54.5 percent of the city’s approximately 110,000 residents report Middle Eastern or North African ancestry, making Arabs the majority.

 

While the Census does not collect religious affiliation, estimates place the Muslim population at around 45,000 residents, or roughly 41 percent, with many analysts suggesting the figure is higher given the predominant Muslim background among Arab Americans in the area.

 

Arabic is spoken in a large share of households, and the city has seen the development of countless mosques, halal markets, and the Arab American National Museum.

 

Abdullah Hammoud, an Arab, was elected mayor in 2021.

 

This pattern of signage for the Muslim population in Dearborn is not entirely new.

 

In 2008, a Walmart Supercenter in Dearborn opened with Arabic signage and a dedicated Middle Eastern foods aisle stocked with items like falafel, olives, and Islamic greeting cards.

 

Many have argued in the replies that going out of the way to accommodate foreign languages in national retailers accelerates the destruction of English as the common language in America and discourages assimilation.
