“The statute allowing noncitizens to vote in local Montpelier elections does not violate Chapter II, § 42 because that constitutional provision does not apply to local elections,” the Supreme Court wrote.

In 2021, the Democrat-controlled Vermont Legislature approved two separate bills to change the municipal charters of Montpelier and Winooski, the most diverse community in the state, to allow legal residents who are not U.S. citizens to vote in local elections. Republican Gov. Phil Scott vetoed the measures, but the Legislature overrode his vetoes.

The Vermont Supreme Court heard oral arguments last week on a lawsuit challenging Burlington’s policy allowing non-U.S. citizens to vote in local elections, including school budget votes. No ruling has been issued as of today.

The case, Morin v. City of Burlington, was originally filed in June 2024 by the Restoring Integrity and Trust in Elections (RITE), a conservative nonprofit.

The suit targets Burlington’s March 2023 charter amendment, approved by 68% of voters, which permits noncitizen residents over the age of 18 to vote on Town Meeting Day, in city council, mayoral, and school district elections.

Burlington, with 44,000 residents, has about 10% foreign-born population, including refugees and green card holders. The policy applies to roughly 1,500 eligible noncitizens. It covers municipal matters like zoning and budgets but not state or federal elections.

Plaintiffs argue the policy violates Chapter II, Section 42 of the Vermont Constitution, which states: “Every person… who is a citizen of the United States… shall be entitled to all the privileges of a voter of this state.”

JEFFORDS MAKING ‘WRITE’ TURN

Turncoat Sen. Jim Jeffords is cashing in on his defection from the GOP – first a tete-a-tete with actress Sharon Stone and now a two-book deal with a big-time New York publisher.

The Vermont senator, who last month quit the Republican Party and turned the Senate over to the Democrats, will pen two memoirs for Simon & Schuster, it was disclosed yesterday. That’s the same publisher that agreed to pay Hillary Rodham Clinton $8 million for her story.

Neither Jeffords nor his publisher would reveal how much he’ll be paid.

The first book, to be called “My Declaration of Independence,” will be published this fall and will contain an expansion of the statement Jeffords delivered in May when he announced his decision to become an independent.

The second, to be published next year, will detail the events leading up to the decision.

In 2001 President GW Bush passed the No Child Left Behind Act. Jeffords excuse for switching parties and putting Dems in charge of the Senate was because he couldn't get additional funding for special education. Seems insincere.

Two days later Jeffords, who died Monday at age 80, would leave the Republican Party that he served in on Capitol Hill for the previous 26 years, first in the House and then the Senate, and would caucus with Democrats. The move ended an historic five-month run in which the Senate sat deadlocked at 50-50 margin, with Vice President Dick Cheney giving Republicans titular control as the tie-breaking vote. Jeffords was handing Thomas A. Daschle (D-S.D.) the title of majority leader and putting the breaks on the domestic agenda of the Bush White House.

Jeffords became the focal point of Reid's efforts during the tax-and-budget battle in the spring of 2001, as the size of Bush's first tax cut kept growing and growing in the Republican-dominated House. Jeffords wanted to rein in the size of the tax cut while also securing funding for special education. Then-Sen. Christopher J. Dodd (D-Conn.), a senior member of Jeffords' committee, began working with Jeffords, letting him know that if Democrats were in charge, more funds would flow to his favored programs.
