Fauci invoked the Fifth Amendment to EVERY question Rand Paul asked him today โ€” including this one:

 

Paul pointed to a red folder sitting directly in front of Fauci containing the federal statute governing a subpoenaed congressional witness who refuses to answer pertinent questions.

 

Paul asked: โ€œDo you have that in front of you?โ€

 

Fauci invoked the Fifth.

 

So now we have a serious legal question.

 

Biden gave Fauci a sweeping pardon covering federal offenses related to his government service from 2014โ€“2025. If truthful answers about that pardoned conduct can no longer expose him to federal prosecution, what remaining criminal exposure supports a blanket Fifth Amendment invocation?

 

Fauci argues that answering today could expose him to a new prosecution if the government later accuses him of lying.

 

But is fear of a future perjury or false-statement prosecution enough to invoke the Fifth to every question โ€” even whether there is a red folder sitting in front of you?

 

And we may now be headed toward a contempt fight.

 

Paul told Fauci that he had denied the assertion of privilege and directed him to answer, then warned that the committee would consider what action to take over his refusal:

 

โ€œThere will be repercussions to your refusal to testify today.โ€

 

So the next question may be just as important as anything Fauci refused to answer:

 

Was his blanket Fifth Amendment invocation legally valid โ€” and if the committee determines it wasn't, what happens next?
