🚨 In a 2-1 vote, the Seventh Circuit ruled that immigrants who entered the U.S. illegally but were later arrested in the country's interior generally cannot be held in mandatory detention while their removal cases proceed.
The majority said Congress "deemed" people who entered the U.S. illegally to be "applicants for admission," but it never said they are automatically "seeking admission." Because the law requires both for mandatory detention, the court held they generally remain eligible to seek bond hearings.
Judge Sykes dissented, arguing that once Congress "deemed" immigrants who entered illegally to be "applicants for admission," they necessarily became "seeking admission" under § 1225. She said the statute therefore requires mandatory detention and accused the majority of creating a broad exception Congress never wrote.
This ruling deepens the existing circuit split on the mandatory detention question, which the Ninth Circuit waded into today as well.
