Federal judge upholds Pentagon's firings of three Stars and Stripes staffers

 

They alleged in the lawsuit filed last week that the Department of War is retaliating against them for publicly expressing concerns about the paper’s future editorial independence under current Pentagon leadership.

In a lawsuit hoping to block the Pentagon from terminating three staffers from the publication, Stars and Stripes, a federal judge declined to block it.

 

Judge Trevor McFadden issued the decision shortly after the hearing that looked at whether two of the three employees were acting within the scope of their roles when they gave interviews to “CBS Sunday Morning” about the historical editorial independence of the newspaper, according to The Hill.

 

The three staffers include publisher Max Lederer, Editor-in-Chief Erik Slavin and reporter Lara Korte. They alleged in the lawsuit filed last week that the Department of War is retaliating against them for publicly expressing concerns about the paper’s future editorial independence under current Pentagon leadership.

 

“Plaintiffs’ own pleadings and the CBS News segment suggest that they spoke as part of their official duties and not as private citizens,” the judge wrote. “They are thus unlikely to succeed on the merits of their First Amendment claim and do not demonstrate irreparable harm.”

 

The three are represented by Taryn Wilgus Null, senior counsel at Democracy Defenders Fund, who said in a statement that they are weighing their legal options.

 

“The judge emphasized a plaintiff’s high burden to obtain a preliminary injunction,” Null told The Hill. “While we are disappointed in the decision, we fully expect to prevail after we have an opportunity to take discovery and all the facts are revealed.”

Supreme Court halts challenge to political parties seeking cheaper TV ad rates

(The Center Square) - The U.S. Supreme Court on Friday halted a challenge to political parties seeking access to cheaper TV ads as a sprint toward the midterm elections commences.

 

Justices on the high court halted a ruling that limited cheaper TV broadcast ads to political candidates. The Federal Communications Commission allows candidates to have access to "lowest unit charge" broadcast rates in the weeks leading up to primary and general elections.

 

"Political candidates, joint fundraising committees with noncandidate members, and political parties engaged in coordinated political activity were all entitled to the LUC subject to certain conditions," justices on the court said of the FCC's rules.

 

Four Democrats, including former Sen. Sherrod Brown of Ohio and Sen. Jon Ossoff, D-Ga., sought to challenge the FCC's rule.

 

The high court said lower court federal judges are not able to intervene in a dispute that is meant to be handled by the FCC. The justices also said political parties will be harmed if they do not get access to the same rates as a candidate.

 

"Current and future rescissions will require the party committees to pay more for advertising space, thereby hampering their efforts to reach the electorate in the critical weeks leading up to the midterms," the justices wrote.

 

Justice Ketanji Brown Jackson dissented from the court's opinion. She argued that the federal judge had proper authority to prevent a political party from accessing cheaper ad rates.

 

The high court ruling follows a June decision in National Republican Senatorial Committee v. FEC, which allowed campaign committees to spend in coordination with national party coalitions across the country, citing First Amendment rights.

 

“Because 'virtually every means of communicating ideas in today’s mass society requires the expenditure of money,' a 'restriction on the amount of money a person or group can spend on political communication during a campaign necessarily reduces the quantity of expression by restricting the number of issues discussed, the depth of their exploration, and the size of the audience reached,'” Justice Brett Kavanaugh said.

 

The high court's ruling gives more time for the NRSC to appeal the federal judge's order and allows political paries to spend more freely ahead of the midterm elections.

A federal judge temporarily blocked on Friday President Donald Trump’s effort to limit the use of mail-in ballots ahead of the November mid-term elections, as ballots are going out in one state.

 

It is the same judge, Boston-based U.S. District Judge Indira Talwani, who blocked an earlier, related effort, ruling that the executive order Trump issued in March was likely unlawful and unconstitutional, according to NBC News.

 

The “court finds, on one side, that immediate implementation of the Final Rule issued less than seventy days before the November 2026 election threatens disenfranchisement of millions of United States citizens who seek to vote by mail,” while “on the other side, that the record includes no evidence relating to fraudulent mail voting to support the rushed implementation of the Final Rule,” Talwani wrote.

“U.S. District Judge Indira Talwani's decision makes one thing clear: She is an activist judge helping the Left block a lawful order that it just doesn't like. The Trump Administration's simple, common-sense rule would put longstanding USPS recommendations into mandatory requirements for elections. But because of one federal district court judge who wants to play lawmaker, it likely won't be able to be implemented in time for the midterms, which will damage public trust in outcomes."
