I don't think you can separate out the importance of the memo to the drop in the market. The markets hate uncertainty above all else, and the memo injected a huge dose of uncertainty. I also think that most investors have grown immune to the annual worry that there will be a terror incident at the Super Bowl. It's always there in the back of your mind, but it has never happened so….

Here are the most relevant sections relative to the current need to designate and detain combatants in the current coup:
Section 1. Findings. (a) Consistent with long-standing law of war principles and applicable law, the United States may detain certain persons captured in connection with an armed conflict for the duration of the conflict.
(c) In addition, the United States may transport additional detainees to U.S. Naval Station Guantánamo Bay when lawful and necessary to protect the Nation.
As long as the coup can be shown to be an "armed conflict" Section 1,a allows for the detention of captured combatants. Section 2,b confers a very broad permission to transport detainees to GITMO "when lawful and necessary to protect the nation". Since POTUS declared a national emergency in December in the human rights/seizing of assets EO all the pieces are in place to detain the coup participants at GITMO.
