Defendants before a Mil Trib are first entitled to a hearing on whether they are proper "enemy combatants." If so, they are subject to the MT; if not, a civil trial ensues.

It's not law or binding. If a US national is plotting with any foreigners to overthrow the govt, that is a criminal conspiracy and they are acting as non-uniformed enemy combatants and may be tried by MT's. There will be a threshhold hearing to determine if they are proper e.c.'s. If Treason is found in concert with any foreign actors, they will be subject to MT's, which is best in these cases because MT's act more expeditiously, with fewer legal rights, including a limited right to a quick appeal. What I expect is that the frist several trials will result in a very damning set of accepted facts. So a lot of the trials will consist of proving that the defendant was also a conspirator in the accepted facts.
