I don't think they wanted to try this in DC, and they couldn't present most of the evidence in a normal court anyway.
The laptop he had was a poison pill that he could use in his defense.
Instead, he flipped on everyone.
And it might be tried as a treason case, in which case military court… or at least another jurisdiction.

There was a big FBI conference call and someone from NY asked why nothing was moving on the Weiner laptop issue.
The lack of action was too obvious as obstruction.
Plus, someone might have threatened to blow the whistle to the press.
Comey was backed into a corner and had to announce it before doing a quick coverup.
