This bill would have produced a watch dog within the Office of Management & Budget, outside of the purview of the Government Accountability Office, and the Congressional Budget Office. It would have had the power to coordinate with INSPECTORS GENERAL.

 

Findings and reports would have been reportable to Congress and publicly available, and referred to the appropriate committee (Committee on Homeland Security and Governmental Affairs of the Senate; the Committee on Appropriations of the Senate;the Committee on the Judiciary of the Senate; the Committee on Oversight and Government Reform of the House of Representatives; the Committee on Appropriations of the House of Representatives; the Committee on the Judiciary of the House of Representatives.)

 

 

BILL SUMMARY:

Regulatory Capture Prevention Act of 2011 - Establishes the Office of Regulatory Integrity in the Office of Management and Budget (OMB), to be headed by an Administrator. Requires the Administrator to investigate and report on the influence of concentrated economic interests on federal agencies that results in: (1) agency action or inaction that fails to advance the mission of the agency or is otherwise inimical to the public interest; (2) regulation, licensing, adjudication, grants, or other agency action that favors a limited number of economic interests or is otherwise inimical to the public interest; (3) enforcement priorities that are not reasonably calculated to accomplish regulatory goals; and (4) a loss of confidence in the integrity of the regulatory process.

 

Grants certain powers to the Administrator to carry out this Act, including access to agency records, subpoena power, direct and prompt access to the head of a relevant agency and access to information and assistance by such agency.

 

Requires the Administrative Conference of the United States to provide the Administrator with written guidance on the principal means by which concentrated economic interests wield influence on federal agencies, the most salient threats to regulatory integrity arising from such influence, and effective measures to minimize regulatory capture.

"Revocation of Certain Executive Orders Concerning Regulatory Planning and Review."

 

Know what it does?

 

It revokes Executive Order 13258 of February 26, 2002 signed by 43.

 

Know what that did?

 

Executive Order 13258 amended Executive Order 13228 of October 8, 2001, which established the department of Homeland Security.

 

And what did EO 13258 add?

 

"(f) As necessary and appropriate, the Task Force shall report to the President, through the Secretary of State, the following: (ii) recommendations for United States policy to monitor and eliminate trafficking in persons and to protect the victims of trafficking in persons."

 

Reporting of Human Trafficking to monitor and remove it. And Barrack Obama revoked it.

 

These people are sick.

Looking at that bill makes me think the GAO & CBO has some fuckery going on and was on lock. Giving the OMB investigative powers proposed in 2011 after BHO fuckered with them in 2009 makes me think something was afoot. I wish more autists would dig on this.

There was a Committee on Homeland Security and Governmental Affairs (i think 7-20-2011?) meeting on S.1338 - Regulatory Capture Prevention Act of 2011, and one of the position papers published recommended an approach towards the OMB more in line with EO 13497, which was about regulation and planning… but also strips the HT verbiage.

 

I forgot to grab a link for that paper, it was like 28 pages, but i am sure you can find it.

I think i am interpreting the EO's correctly. I wish some lawfags would chime in and double check me. You have to go through all of them to see what the original did, vs. the subsequent amendment, and the further revoke by BHO.
