If it was known and no action taken it would probably go back to the whole "firewall," thing. WHO are the firewalls? Firewalls in DOJ and FBI. Deliberate would indicate premeditation and would dictate that the firewalls had to be in place first to cover and to abuse their positions. Like any good mystery, motive and opportunity are key.
How might this discredit the FBI's investigation into HRC's emails?
Timing and silence. If they knew that access to the servers was deliberate and did nothing about it at the time they found out, that makes them accomplices due to inaction.
