lawfag here. It really shouldn't matter about knowing of a prior application. Each application has to stand on its own and be supported with sufficient material fact presented by the DoJ/FBI via sworn affidavits. If FISA warrants are like routine criminal warrants, the judge could grant it on its face. Or perhaps the judge might want to question the applicants on particular issues. But here, it appears it was all gamed and that the judge just rubber-stamped the app and warrant.
