You can indict anybody, It's bringing them in for questioning.
I may have to take back what I said then. Will do some digging on indicting elected officials.
O.k. I think I've got it. An indictment is brought by a grand jury if enough evidence is brought forth to look like a case is possible. It is still only an accusation but there should be enough proof to convict. Most recent case against a Supreme Court justice is in West Virginia. Supreme Court justice Loughry. It does not look like they have to be impeached prior to an indictment.
