Ask people to name the key minds that have shaped Americaโ€™s burst of radical right-wing attacks on working conditions, consumer rights and public services, and they will typically mention figures like free market-champion Milton Friedman, libertarian guru Ayn Rand, and laissez-faire economists Friedrich Hayek and Ludwig von Mises.

 

James McGill Buchanan is a name you will rarely hear unless youโ€™ve taken several classes in economics. And if the Tennessee-born Nobel laureate were alive today, it would suit him just fine that most well-informed journalists, liberal politicians, and even many economics students have little understanding of his work.

 

The reason? Duke historian Nancy MacLean contends that his philosophy is so stark that even young libertarian acolytes are only introduced to it after they have accepted the relatively sunny perspective of Ayn Rand. (Yes, you read that correctly). If Americans really knew what Buchanan thought and promoted, and how destructively his vision is manifesting under their noses, it would dawn on them how close the country is to a transformation most would not even want to imagine, much less accept.

This has been predicted on several occasions lately (can't find sauce in a hurry). Finally took a while to surface.

Now saying something is one thing, having it ratified in law is entirely another.

Problem is plaintiff has to demonstrate actual malice of accused.

In 2014 the Ninth Circuit Court ruled that liability for a defamatory blog post involving a matter of public concern cannot be imposed without proof of fault and actual damages. Bloggers saying libelous things about private citizens concerning public matters can only be sued if they are negligent i.e., the plaintiff must prove the defendant's negligence โ€“ the same standard that applies when news media are sued. The Court held that in defamation cases not the identity of the speaker, but rather the public-figure status of a plaintiff and the public importance of the statement at issue provide the First Amendment foundation.

Once again, Kissinger outed the cabals plan many years ago:

leak tech to Russia and China to hasten the bootstrapping of their industries so as to make them more cocky. Thus they will be more easily enticed into belligerence.
