we haven't had this exact situation hapen before so we have to look at the "Spirit" of the decisions. I think they support the possibility of HRC in a tribunal. We will only know if it holds up once the SC addresses it. Think about how many times her and BHO said they are now citizens when Trump took office. They stressed that fact for almost a year.
none of us are constitutional lawyers so it is impossible for us to guess at whether a military tribunal will hold up at the SC. We do know none of them will go down without a fight. The legal authority to call for military tribunals already exists and has since 9/14/01. We will have to wait and see if on a case by case basis it holds up. BHO's situation will be d ifferent than HRC's because I beieve it will be proven that he is not a citizen. All of this constitutes a Constitutional Crisis. The SC is where it will be handled.
