400 charges against Merkel: including high treason and smuggling of human beings

One of the accusations: Angela Merkel would have committed treason because refugee policy endangers the constitutional order. Such complaints have no chance of success, according to criminal law experts.

As the Office of the Attorney General of the Federal Republic of Germany informed "Focus Online", almost 400 criminal charges have been filed against Angela Merkel, which fall within the jurisdiction of the Federal Attorney General. The Federal Prosecutor's area of responsibility covers serious criminal cases involving state security which have a particular impact on the internal or external security of the Federal Republic of Germany.

According to the spokeswoman of the Federal Attorney General, Frauke Köhler, to the medium, criminal charges would be dutifully examined.

Although the Federal Prosecutor's Office did not comment on the content of the accusations, there are examples of charges against Angela Merkel on the Internet which accuse the Chancellor of high treason, among other things.

Paragraph 81 of the Criminal Code stipulates: "Anyone who undertakes to use force or threatens to use force

  1. to impair the existence of the Federal Republic of Germany or

  2. to change the constitutional order based on the Basic Law of the Federal Republic of Germany is punishable by life imprisonment or imprisonment for no less than ten years".

Thus, for example, the lawyer Heumann substantiates the decision of the Federal Chancellor to let permanent residents into the country in Hungary: The "constitutional order" could be 'changed', if not completely undermined and abolished by "the historically unprecedented mass influx of foreign refugees from the Third World". Angela Merkel had put the Germans "under living conditions that are capable of bringing about their physical destruction in whole or in part".

Rene Schneider, director of the Institute for International Law, has also filed charges of treason against the constitution. The Institute has taken up the cause of bringing to justice the war criminals and state criminals who participated in the NATO attack on the sovereign Federal Republic of Yugoslavia in 1999.

Schneider wrote on 24 October to the Federal Attorney General: "The accused have not only violated their official duties by omission, but they have also actively and aggressively invented an unnatural as well as illegal 'welcome culture'" and thus lured "self-proclaimed 'refugees' (…) to illegal entry into Germany".

Holm Putzke, professor of criminal law at the University of Passau, told "FOCUS Online": "In short, such reports are insubstantial and will not be successful". Neither the conditions of § 81 StGB nor of § 105 StGB (coercion of constitutional organs) are given according to the information available to him.

According to the law, "treason" is only present if the perpetrator "acts by force or by threat of force".

In the case of state security regulations, violence is not identical with the concept of violence, which can be found in criminal offences that protect individual legal interests. The threshold for state protection offences is significantly higher.

"Due to their special obligation to the general public, constitutional bodies may be expected to withstand even turbulent political disputes and pressure situations. Moreover, he was not able to recognise that the existence of the Federal Republic of Germany had been "impaired" by migration movements to date.

Putzke accused Merkel's government of smuggling immigrants into Germany

Shortly before, Putzke had caused a stir with a criminal examination of Merkel's refugee policy. It was about the accusation whether the Chancellor was acting as a smuggler with her refugee policy.

He came to the following conclusion: "As long as foreigners make themselves liable to prosecution if they enter the Federal Republic of Germany without permission, they are also liable to prosecution for all those who help to do so".

This also includes the German Chancellor, who "actively promoted unauthorised entry with her conduct from 5 September 2015 and currently refrains from preventing it". (dk)

I think Merkel's in the final. Hopefully she will soon be history. After that, Europe has a chance to recover.
