Some clarifications on the points raised in the last thread: While recess appointments for SCOTUS are technically possible under the Constitution, since 1960 the Senate has considered that possibility to be off the table.

 

In theory, McConnell could throw the Senate into recess for this purpose, but that course of action would be fraught with difficulty and would seem an extremely unlikely strategy.

 

Then again, we could be in extreme territory pretty soon.

I hope admissions is handled better than in Scranton, PA, where somehow there were tens of thousands of people holding "tickets" stuck outside the venue
