I believe any adult conviction should be something the Senate could consider in a confirmation process.

 

Uncharged conduct, no.

Allegations that didn't result in a conviction, no.

 

Even when there is a conviction, the Senate could consider other factors that may mitigate the prior crime. This is the same process (at least in my state, New Jersey) that allows people that were convicted of crimes when they were young to later obtain professional licenses, etc.
