Trump has NOT nominated anyone (including Panuccio) for the position vacated by Brand. Panuccio is only “acting”. How long can he stay “acting”? 210 days according to the Vacancies Reform Act.

Since there has been no official nomination by Trump, the RULE OF LAW BARS anyone from serving in an ACTING capacity.

No one may serve as the “acting officer” in this situation. Only the head of the Executive agency may perform the function or duty of the office.
