As much as I hate the idea of new laws (I really fucking hate it, we don't need more, we need fewer), this would put a damper on the bullshit accusations. Facing a long prison term would deter most (there's always loons) from knowingly making bogus accusations.

It isn't or shouldn't be hard to find a good sex crimes prosecutor. Since every decent sized DA/AG office has at least one. I bet Katz et al will cut bait on Wednesday or Thursday morning (contempt citation, anyone?). They'll delay, delay, delay, then decide the "terms" are unreasonable and cut bait, run.

I am a lawfag. A reformed one, not practicing, but have that JD. There is no comparable criminal law. Defamation isn't criminal, it's a civil tort. Won't serve a day in jail, can only place a lien on assets and IIRC they can get out of the judgment through bankruptcy.

 

Obstruction of justice would apply but that doesn't come anywhere close to providing justice. Likewise with filing a false police report. Maybe a year in prison compared to 5, 10, 15, 20, 25 years for a rape conviction. I simply don't see anything on the books that can address this issue. And to file a defamation action, one needs money. So only those who have resources may pursue that avenue, unless some attorney steps up and handles pro bono.

Yep we need to do away with absolute immunity. And legislative immunity. We need to create exceptions to it at least. Because what Feinstein is doing now isโ€ฆit isn't illegal. The law sees NOTHING WRONG with what she's been doing. Knowingly infringing on the civil liberties of Americans (like voting for draconian gun control laws) should be cause of action for a 1983 action. At bare minimum. I've seen judicial immunity piercedโ€ฆtwice. Prosecutorial immunity pierced, a couple times. Hardly ever.

Perjury isn't easily prosecuted and regardless, it doesn't carry adequate punishment for ruining someone's career and personal life. I want something for the most egregious offenses such as what is being done to Kavanaugh. Perjury will get maybe 6 months in jail, year at most.

Yep and bankruptcy code has loopholes. I never practiced bankruptcy law, my memory of it from school is foggy at best, but I believe her shit can't (in this case) be discharged in bankruptcy. Depends if the court found there was malice. That can't be discharged in Chapter 7. Defamation due to negligence or even gross negligence is dischargeable but malicious defamation cannot. Not to mention all of the stuff (you) outlined. Fines and judgments can be paid by sugar daddies but a prison sentence, well, that can only be served by the defendant herself (or himself).

Also need a "loser pays" rule. Not just in litigation but accusations. If I have to retain a lawyer to deal with some facially false allegation then the accuser should be forced to pay my expenses when allegations found to be incredible or some fuckery is found.

There's always a downside. Would force attorneys to more closely evaluate pro bono cases they're considering taking. Would reduce pro bono, but that's not necessarily a bad thing. Who knows, Katz may be doing this pro bono. Sanction lawyers who suborn this shit too. Actually sanction them and fucking suspend their licenses or permanently disbar them. Send a message, don't file frivolous bullshit and don't continue repping a plaintiff who they know is LYING.
