The flaw in the declaration which Avenatti drafted for Swetnick is that she does not positively identify her "Brett Kavanaugh" as the Brett Kavanaugh. "Met" and "introduced" without more is insufficient foundation.
Another flaw is that the declaration does not establish any personal knowledge that a girl was actually inside the room where boys lined up outside. It could have been a bathroom. It could have been empty. Again, the declaration lacks foundation.
