FYI, if the FBI stumbles upon an obvious crime during its background investigation, it can refer the matter to the DOJ's criminal division. This is the same no matter what federal organization stumbles onto a crime.
This is why congress has referred many matters to the DOJ from its investigations.
This is why Martha Stewart was convicted. The SEC referred it to the DOJ/FBI and they caught Martha in a lie.
