Serious question…what exactly "abuse" in the context of "fraud, waste, and abuse"? I ask Federal policies seem to group the 3 together all the time but curiously this new DOJ framework for the DOJ to work with Inspector Generals (see link below and SEE PICS) only deals with FRAUD and WASTE.

 

What about abuse? Is it abuse of power? Is it failure to provide honest services? Is abuse in the context of the 3 more sinister and therefore being dealt with differently?

 

I just want to sort out how this new framework is dealing with the 3rd element of abuse.

 

Is abuse in the context of "fraud, waste, and abuse" being handled as human rights abuse under the "Executive Order Blocking the Property of Persons Involved in Serious Human Rights Abuse or Corruption"?

If YES then this is YUGE!

Interesting article defining 'abuse of power'…

 

“High crimes and misdemeanors” is not a legal term, but a political one.

 

Therefore, abuse of power can be a “high crime and/or misdemeanor,” and the agency charged with oversight of that office could call for impeachment proceedings if they can substantiate a charge of “abuse of power.”

 

But what, exactly, is “abuse of power?” It can also be called “malfeasance in office” or “official misconduct.” It is the commission of an unlawful act, in an official capacity, which affects the performance of official duties. It is also using official power for personal gain.

 

So in order to substantiate a charge of abuse of power, you have to show that the officiant:

 

Committed an unlawful act in an official capacity

And that this unlawful act affected the officiant’s ability to perform his or her duties

or that the officiant:

 

Used official powers of the office for personal gain
