The Due Process Clause in the U.S. Constitution states that no person will be โdeprived of life, liberty or property without due process of law.โ
This clause can be found in the U.S. Constitution not once but twice. Both the Fifth Amendment and Fourteenth Amendment binds all states to the Due Process Clause. It is integral to the function of the Constitution, and the clause promises all Americans fair treatment equally under the law.
Bound within the clause is the ancient western principle of the presumption of innocence.
According to Wabash Law:
Due process of law requires that orderly legal procedures be followed to establish guilt before a person can be put in jail or otherwise punished. In the United States, a person is considered innocent until proven guilty. The 14th amendment to the U.S. Constitution guarantees to every person, aliens included, โequal protection under the law.โ
However, is Brett Kavanaugh deserving of these constitutional rights given to all of us?
