Why did POTUS interview (FBI Dir) Mueller a day prior to SC appointment if impossible to assign position?

With Gorsuch appointment eminent, POTUS explained to Mueller that with his future nominations (3/4/5?), all would uphold Military Tribunals. Mueller could choose to play along or face the hangman.
