The Role and Authority of OPR in Attorney Misconduct Matters
OPR has jurisdiction to investigate allegations of professional misconduct against Department attorneys that relate to the exercise of their authority to investigate, litigate, or provide legal advice, including allegations of professional misconduct against Department immigration judges. OPR also has jurisdiction to investigate allegations of misconduct against Department law enforcement personnel that relate to allegations of attorney misconduct within the jurisdiction of OPR. Generally, OPR does not investigate allegations that have been presented in litigation and for which a court has not made a finding of misconduct. The Office of the Inspector General has jurisdiction over all allegations of misconduct against Department attorneys that do not fall within OPR’s jurisdiction.
